STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fourteen

AN ACT establishing a committee to study the establishment of a fund to reimburse costs associated with firefighters who have cancer.

Be it Enacted by the Senate and House of Representatives in General Court convened:

182:1 Committee Established. There is established a committee to study the establishment of a fund to reimburse costs associated with firefighters who have cancer.

182:2 Membership and Compensation.

I. The members of the committee shall be as follows:

(a) Three members of the house of representatives, one of whom shall be from the minority party, appointed by the speaker of the house of representatives as follows:

(1) One member from the ways and means committee.

(2) One member from the commerce and consumer affairs committee.

(3) One member from the labor, industrial and rehabilitative services committee.

(b) One member of the senate, appointed by the president of the senate.

II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

182:3 Duties. The committee shall review the impact of the 1990 superior and supreme court cases relative to the constitutionality of enforcing RSA 281-A:17, II. The committee’s study may include, but not be limited to, the cost effect to workers’ compensation claims relative to firefighter occupational-related cancer disease in New Hampshire and potential funding methods to address the concerns raised by the 1990 court cases.

182:4 Chairperson; Quorum. The first-named house member shall be the chairperson of the committee and shall call the first meeting of the committee. The first meeting of the committee shall be held within 30 days of the effective date of this section. Three members of the committee shall constitute a quorum.

182:5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2014.

182:6 Effective Date. This act shall take effect upon its passage.
