AN ACT relative to the code for energy conservation in new building construction.

ANALYSIS

This bill permits municipalities to decide whether or not to enforce the code for energy conservation in new building construction.

This bill also permits an individual to refuse to have the code for energy conservation in new building construction enforced against him or her.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to the code for energy conservation in new building construction.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Energy Conservation in New Building Construction; Administration. Amend RSA 155-D:4 by inserting after paragraph I the following new paragraph:

I-a. The legislative body of a town or city may, at the annual meeting, by an affirmative majority vote of those present and voting, decide whether to enforce the provisions of this chapter.

2 New Paragraphs; Energy Conservation in New Building Construction; Exemptions. Amend RSA 155-D:7 by inserting after paragraph IV the following new paragraphs:

V. Towns or cities that have voted to not enforce this chapter under RSA 155-b:4, I-a shall be exempt from the provisions of this chapter.

VI. Any individual who notifies the governing body of any town that he or she objects to having the provisions of this chapter enforced against him or her shall be exempt from such enforcement.

3 Effective Date. This act shall take effect 60 days after its passage.
