AN ACT relative to the supervision of a real estate office and the duties of a facilitator under the real estate practice act.

This bill removes the requirement for on-site real estate office supervision by a principal broker or managing broker. The bill also clarifies a facilitator’s duty to present all offers and agreements.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fifteen
AN ACT relative to the supervision of a real estate office and the duties of a facilitator under the real estate practice act.
Be it Enacted by the Senate and House of Representatives in General Court convened:
87:1 Real Estate Office; Supervision. Amend RSA 331-A:16, II to read as follows:
II. All licensees and employees associated with a real estate office shall be reasonably supervised [on site] by the principal broker or managing broker.
87:2 New Paragraph; Facilitator; Duty. Amend RSA 331-A:25-f by inserting after paragraph VII the following new paragraph:
VIII. A facilitator shall present in a timely manner all offers and agreements to and from the parties during a real estate transaction.
87:3 Effective Date. This act shall take effect 60 days after its passage.
