AN ACT relative to membership in a union.

ANALYSIS

This bill permits the members of a union to vote to decertify the union if membership falls below 50 percent. This bill also permits employers to require such a vote if the number of employees who pay union dues falls below 50 percent of the total number of employees.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT relative to membership in a union.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Vote to Decertify. Amend RSA 275 by inserting after section 2 the following new section:

275:2-a Vote to Decertify Union.

I. Whenever membership in a labor organization falls below 50 percent of the employees of an employer, the members may vote to decertify such organization by secret ballot.

II. Whenever the number of employees who pay union dues falls below 50 percent of the total employees of the employer, such employer may require the members to vote, by secret ballot, on whether to decertify the union.

2 Effective Date. This act shall take effect 60 days after its passage.
