STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Fifteen

AN ACT prohibiting the payment of subminimum wages to persons with disabilities.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Minimum Hourly Rate; Payment of Subminimum Wages. Amend RSA 279 by inserting after section 21-a the following new section:

279:21-b Payment of Subminimum Wages. Except as provided in RSA 279:22-aa and RSA 279:26-a, no person shall employ any individual with a disability as an employee at an hourly rate lower than that set forth in RSA 279:21.

2 Wage Adjustment. Amend RSA 279:22-b to read as follows:

279:22-b Wage Adjustment. The commissioner of labor is hereby directed to readjust minimum wages for employees insofar as it may be necessary in view of the provisions of RSA 279:21 [and 22].

3 Repeal. The following are repealed:

I. RSA 279:22, relative to special authorization in certain cases.

II. RSA 279:22-a, relative to special authorization for sheltered workshops.

4 Effective Date. This act shall take effect 60 days after its passage.
