AN ACT repealing an increase in the fuel oil discharge cleanup fund fee.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Fuel Oil Discharge Cleanup Fund; Fee. Amend RSA 146-E:3, II to read as follows:
II. A fee of [$0.0125] $0.01 per gallon of fuel oil shall be assessed at the time of importation into this state.
2 Effective Date. This act shall take effect July 1, 2015.

HB 462-FN - FISCAL NOTE
AN ACT repealing an increase in the fuel oil discharge cleanup fund fee.
FISCAL IMPACT:
The Department of Environmental Services states this bill, as introduced, will decrease state restricted revenue and expenditures by $581,000 in FY 2016 and each year thereafter. There is no impact on county and local revenue and expenditures.
METHODOLOGY:
The Department of Environmental Services states this bill reduces the per gallon fee for oil fuel by $0.0025 from $0.0125 to $0.01. The Department states FY 2014 revenue to the fuel oil discharge cleanup fund was $2,904,971 and assumes revenue would remain near this amount in future years with no change to the fee. This bill will decrease revenue to the fuel oil discharge cleanup fund by approximately 20 percent or $581,000 (estimated revenue of $2,905,000 * 20 percent). The decrease in revenue will also decrease expenditures from the fund to eligible tank owners for the purpose of contamination cleanup projects.
