AN ACT relative to charter school memorandums of understanding.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Chartered Public Schools; Authority and Duties of Board of Trustees; Memorandum of Understanding. Amend RSA 194-B:5, VIII(c) to read as follows:
(c) Prior to [the start] November 1 of each school year, the chartered public school and the school district shall review and update the MOU to ensure compliance with state and federal law and responsibilities to provide services in accordance with individualized education plans.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill, presumed effective for the 2024-2025 school year, would change the date by which the district and charter school shall have reviewed and updated the memorandum of understanding (MOU) related to service provision for students with disabilities attending charter schools from the start of each school year to November 1. The Department of Education states this bill’s impact on local district expenditures is indeterminable as local school district budgets are completed prior to November 1 in the previous school year, enabling towns to set their tax rates and without the information determined in the MOU, it is difficult for school districts to budget those expenditures appropriately. The Department further states that if the MOUs aren’t done until after school starts, districts may struggle to find service providers, or funding to pay for service providers as well as staff to provide services at the charter school if necessary. This could potentially increase costs for districts as they may need to contract with other providers to obtain the services needed to meet student needs. With the current difficulties all districts are having with finding staff and service providers this would make finding staff and service providers for charter schools extremely difficult, near impossible after the school year starts. Ultimately, any impact this bill may have on local school district expenditures in FY 2025, and beyond, is indeterminable.
