McAULIFFE-SHEPARD DISCOVERY CENTER COMMISSION

 

(formerly the Christa McAuliffe Planetarium Commission)

 

NOTE:

 

            Established effective 4-22-88 pursuant to 1998, 160:1.  The Christa McAuliffe Planetarium Commission was within the Office of the Commissioner, Department of Regional - Community Technical Colleges (Rctc) pursuant to 1995, 133:13, effective 7-1-95.  See RSA 188-F:61.  However, the Commission still had its own rulemaking authority pursuant to and RSA 188-F:62, VII.

NOTE:

 

            RSA 188-F:57-67 were repealed by 2001, 136:4, effective 7-1-01 and replaced by RSA 12-L:1-12, but, pursuant to 2001, 136:3, existing rules remained in effect “until amended, replaced, or repealed through adoption of rules by the commission pursuant to RSA 12-L:7, II(b).  Rulemaking authority subject to RSA 541-A is in RSA 12-L:7, II(b).

 

            RSA 12-L:6, providing administrative attachment to the Department of Regional-Community Technical Colleges, was repealed by 2007, 39:6, effective 7-1-07.

 

NOTE:

 

            The Christa McAuliffe Planetarium Commission was renamed the McAuliffe-Shepard Discovery Center Commission pursuant to 2009, 13:3, effective 4-17-09, with rulemaking authority under RSA 12-L:7, II(b) pursuant to 2009, 13:4.

 

NOTE:

 

            Pursuant to 2011, 224:88, I, effective 7-1-11, and 2012, 173:1, effective 6-11-12, the functions, positions, powers, duties, responsibilities, and funding of the McAuliffe-Shepard Discovery Center was transferred from the McAuliffe-Shepard Discovery Center Commission to a private operator, the McAuliffe-Shepard Discovery Center Corporation on January 1, 2013.  The Commission has remained a state agency established under RSA 12-L:7 with rulemaking authority under RSA 12-L:7, II(b).  However, pursuant to RSA 12-L:7, I(g), adopted by 2012, 173:3, effective 6-11-12, the Commission must coordinate with the private operator “to achieve an orderly transition from operation of the discovery center as a state agency to operation of the discovery center by the private operator.”

 

            No rules were subsequently adopted or filed by the Commission.
