PART Agr 2901  EQUINE QUARANTINE FROM CEM COUNTRIES

 

          Agr 2901.01  Statement of Purpose.  The purpose of this part is to  regulate owners or authorized agents of equine quarantine facilities set up to hold horses and/or ponies from CEM affected countries, and set minimum standards and guidelines for their care, testing and release.

          Agr 2901.02  Definitions.

 

          (a)  “Approved quarantine facility” means an equine holding facility approved by the state veterinarian and federal veterinary personnel for holding and handling horses from CEM affected countries per U.S.D.A. regulations pursuant to 9 CFR, subpart C, sections 93.301 and 93.304 published in the Code of Federal Regulations, January 1, 2007.

 

          (b)  “Contagious equine metritis” or “CEM” means an infectious reproductive disease of the equine species.

          Agr 2901.03  Quarantine Procedures.  The quarantine procedures for equine species shall be enforced by the state as listed in 9 CFR, subpart C, sections 93.301 and 93.304 published in the Code of Federal Regulations, January 1, 2007.

          Agr 2901.04  Application.

 

          (a)  The owner or agent of the equine quarantine facility shall file an application with the department of agriculture, markets and food to receive stallions and mares from CEM affected countries.

 

          (b)  The application shall contain the following:

 

(1)  Name of owner or authorized agent and address;

 

(2)  Country of origin for the horse or pony;

 

(3)  Name and location of U.S.D.A. quarantine station where animals were received from a CEM country;

 

(4)  Name, breed, age, sex, description and identification of equine to be quarantined; and

 

(5)  Name and address of veterinarian employed to perform testings.

 

          (c)  The owner or agent of the equine quarantine facility shall comply with all provisions as listed in 9 CFR, subpart C, sections 93.301 and 93.304 published in the Code of Federal Regulations, January 1, 2007 and shall review the appropriate handling and testing procedures for stallions and mares with the state veterinarian in those regulations.

 

          (d)  The applicant shall reimburse the state of New Hampshire for expenses incurred by the state veterinarian and the division of animal industry of the department of agriculture, markets and food for CEM inspections and monitoring.  The reimbursement fee shall be mileage expense, which means the round trip mileage from the tester’s official headquarters to the destination at a rate set by the state each year, in accordance with the provisions of the collective bargaining agreement, and the hourly expense of the state veterinarian or his agent for the time spent to travel and monitor the importing and testing procedures and any administrative time used to fulfill the intent of the quarantine.  Reimbursement shall be accomplished before the animal is released from quarantine.

          Agr 2901.05  Laboratory Testing.  All laboratory testing shall be performed at diagnostic laboratories approved by Veterinary Services, USDA, Animal and Plant Health Inspection Service.

          Agr 2901.06  Procedures for Handling Equines Imported From CEM Countries.

 

          (a)  The quarantine facilities shall be separated from other buildings where horses are housed as follows:

 

(1)  All doors or gates shall be secured; and

 

(2)  All paddocks, pastures or exercise areas shall be properly fenced to prevent escape and contact with any other horses.

 

          (b)  The owner or agent shall designate personnel to care for the animals in quarantine and to be responsible for their knowledge of the requirements. 

 

          (c)  Personnel pursuant to (b) above shall wear boots that shall be disinfected with a germicide/viruside prior to entry and on leaving the quarantine facility.

 

          (d)  Protective clothing for personnel who care for the animals shall be available at the entrance of the quarantine facility and shall be used only in the facility.

 

          (e)  The accredited veterinarian shall be responsible for sterilization of his or her equipment and supplies used in a quarantine facility.  “Accredited veterinarian” means a licensed veterinarian approved by the USDA-APHIS administrator and the state animal health official to perform duties as outlined in 9 CFR, 161.2(d)(1) through (16) published in the Code of Federal Regulations, January 1, 2007.

 

          (f)  Manure, bedding, hay and other material from the quarantine area shall be spread on open crop land, incinerated or burned in accordance with local requirements.

 

          (g)  All gloves, sleeves, speculums and other disposable material after each culture or treatment shall be placed in plastic garbage bags and stored in the quarantine facility until burned, autoclaved or the quarantine is released.

 

          (h)  All equipment used in the stalls or on the animals shall remain in the quarantine area.

 

          (i)  Visitors shall not be permitted in the quarantine area.

 

          (j)  A horse under quarantine shall remain in the quarantine facility until all laboratory results indicate that the horse in quarantine is CEM free.

 

          (k)  If any medical emergency occurs requiring medical treatment in an equine hospital during non-office hours of the state veterinarian and the state veterinarian cannot be reached at home, the farm manager shall notify the equine hospital of the fact the animal is under quarantine for CEM.  The farm manager shall not transport such equine unless he receives assurance from the equine hospital that the quarantine shall be maintained in that equine hospital.

 

          (l)  If a quarantined horse escapes, the escape shall be reported within an hour of discovery to the state veterinarian.
