CHAPTER Cmp 100 ORGANIZATIONAL RULES

PART Cmp 101 DEFINITIONS

Cmp 101.01 Statutory Definitions Adopted. The definitions established in RSA 188-F:57 shall also apply to these rules.

PART Cmp 102 DESCRIPTION

Cmp 102.01 Commission. The commission is established under RSA 188-F:58 and has rulemaking authority under RSA 188-F:62, VII, relative to the rights and responsibilities of parties utilizing the planetarium facilities. Fees for planetarium use are set and collected by the commission under the provisions of RSA 188-F:62, III.

Cmp 102.02 Open Meetings and Quorum. The following shall apply to commission meetings:

(a) The commission shall meet at least 6 times a year;

(b) Each commission meeting shall be open to the public in accordance with RSA 91-A;

(c) Notice of each meeting shall be posted at the planetarium office and the State House at least 7 days prior to the meeting, except that rulemaking hearings shall also meet the additional notice requirements of RSA 541-A:6; and

(d) A quorum of the commission shall be 8 members.

Cmp 102.03 Departmental Unit. Under RSA 188-F:61, the commission and the planetarium function within the office of the commissioner of the department of regional community-technical colleges established under RSA 188-F:2.

Cmp 102.04 Director. The daily operations and staff of the planetarium are under the management of a director appointed as an unclassified employee under RSA 188-F:63.

PART Cmp 103 REQUESTS FOR INFORMATION

Cmp 103.01 Addressed to Director. All requests to the commission for information under RSA 541-A:16, I (a) shall be sent to the director in writing at the following address:

Cmp 103.02 Response. The director shall respond to requests in accordance with RSA 541-A:29, and shall place any item requiring commission action on the commission agenda in accordance with the time frames of RSA 541-A:29. For purposes of this rule, "an item requiring commission action" means one which falls within the definition of the commission's powers and duties under RSA 188-F:62, including but not limited to the redesign of programs, fees, and the acceptance of gifts, grants, or donations.
