CHAPTER Saf-C 1400  CARNIVAL-AMUSEMENT RULES (RSA 321-A:2)

 

REVISION NOTE #1:

 

        Document #5607, effective 4-2-93, adopted rules relative to bungee jumping.  Document #5607 contains a new part numbered Saf-C 1410 and new and amended rules in Saf-C 1401.  The insertion of the new rules in Saf-C 1401 required the renumbering editorially of most of the new and existing rules in Saf-C 1401.  The text of the existing rules in Saf-C 1401 was not included in Document #5607, and therefore the effective dates for these existing rules remain unchanged by Document #5607.

 

        Document #5445, effective 8-12-92, contained emergency rules relative to bungee jumping, but these emergency rules EXPIRED: 12-10-92.  Document #5445 contained new and amended rules in Saf-C 1401 and a new part numbered Saf-C 1410.

 

REVISION NOTE #2:

 

        Document #10507, effective 1-21-14, adopted rules in Saf-C 1400 which had expired and readopted or readopted with amendments other existing rules in Saf-C 1400.  Those rules with source notes which indicate that the rules or selected paragraphs had expired 1-2-14 had provisions which had been subject to extension pursuant to RSA 541-A:14-a, I past their normal expiration date of 4-28-13.  They had expired pursuant to RSA 541-A:14-a, II and III(a) because the rules had not been adopted by the Department of Safety within 30 days after the agency was allowed to adopt under RSA 541-A:14, I.

Saf-C 1401.082  “Challenge course” means a guided aerial exploration of transit, which is open to the general public, of the forest canopy, by means of a series of zip lines or aerial walkways or platforms, including beams, bridges, cable traverses, climbing walls, nets, platforms, ropes, swings, towers, and zip lines, which may be installed in or on trees, or portable or permanent structures. The term includes “canopy tours”.

          Saf-C 1401.27  “Physical operator” means the person who physically controls the operation of a carnival or amusement ride while said carnival or amusement ride is being used by, or is open to the public.

          Saf-C 1401.331  “Zip line” means a lifeline suspended between support structures that enables a person attached to a pulley to traverse from one point to another propelled only by the force of gravity.

          Saf-C 1401.34  Scope.

 

          (a)  The department shall construe “carnival or amusement ride” as defined in RSA 321-A:1, I to include but not be limited to the following:

 

(1)  Water slides;

 

(2)  Alpine slides;

 

(3)  Mountain coasters;

 

(4)  Bumper boats;

 

(5)  Go carts;

 

(6)  Water rides or conveyances;

 

(7)  Bungee jumping;

 

(8)  Slides over 8 feet in height;

 

(9)  Devices that require the user to wear a body harness;

 

(10)  Air supported structures;

 

(11)  Amusement attractions;

 

(12)  Homemade rides;

 

(13)  Challenge courses, and

 

(14)  Zip lines.

 

          (b)  Unless otherwise specifically stated in these rules, all devices listed in (a) above shall be subject to the provisions of these rules.  Carnival or amusement rides not subject to these rules shall be those such as coin operated rides.

PART Saf-C 1402  SAFE INSTALLATION

 

          Saf-C 1402.01  Standards.

 

          (a)  All carnival or amusement rides, except as set forth in (b) below, shall conform to the standards set forth in the 8th edition of the American Society for Testing and Materials (ASTM) Standards on Amusement Rides and Devices (2012), available as noted in Appendix B.

 

          (b)  Challenge courses and zip lines that are not built on concrete or steel footings shall conform to the standards set forth in the 16th edition of the American National Standards Institute (ANSI)/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B.

 

          (c)  Challenge courses and zip lines that are built on concrete or steel footings shall conform to the standards set forth in (a) above.

 

          (d)  Homemade rides or devices shall be:

 

(1)  Built to conform to or exceed the standards set forth in the 8th Edition of the ASTM Standards on Amusement Rides and Devices (2012), available as noted in Appendix B; and

          Saf-C 1402.02  Responsibility.

 

          (a)  The responsibility for the safe installation of a carnival or amusement ride shall rest with the owner or operator.

 

          (b)  The owner or operator shall provide safety devices, a safe work environment and safety equipment which meet all state and federal regulations including but not limited to hard hats, body harnesses, and appropriately designed and installed electrical equipment.

Saf-C 1402.03  Safety Factors.

 

(a)  All consideration for public safety shall be given in designating the location of each carnival or amusement ride and the safe installation thereof, including but not limited to the following:

 

(1)  The physical nature of surrounding objects or surfaces that might produce undesirable contact for the riders of the carnival or ride;

 

(2)  The reasonably foreseeable changes that are likely to occur in the location or nature of the surroundings;

 

(3)  Site to be free from large rocks, debris or any holes; and

 

(4)  Site to be sufficiently level to provide safe operation of the ride or device.

 

(b)  Conductors shall have a vertical clearance to ground in accordance with Article 525.5 of the National Electrical Code, NFPA 70, 2017 edition published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10.  These clearances shall apply only to wiring installed outside of tents and concessions.

 

(c)  Amusement rides or devices shall be maintained not less than 4.5 m (15 ft) in any direction from overhead conductors operating at 600 volts or less, except for the conductors supplying the amusement ride or device.  Amusement rides or devices shall not be located under or within 4.5 m (15 ft) horizontally and extending vertically to grade of conductors operating in excess of 600 volts.

          Saf-C 1402.04  Fences Required.

 

          (a)  All carnival or amusement rides, except for challenge courses and zip lines, shall be surrounded by fencing in accordance with the requirements of the 8th Edition of the ASTM Standards on Amusement Rides and Devices (2012), available as noted in Appendix B.

 

          (b)  Each fence opening shall have a hinged gate adequate to prevent a child from inadvertently entering the enclosed area.

 

          (c)  All gates in the fence surrounding a carnival or amusement ride shall include a latching device that engages when the gate is closed.

 

          (d)  Fences and gates shall be constructed and installed so as to prevent riders or spectators from touching the carnival or amusement ride and fences or gates at the same time.

 

          (e)  All fencing and gates shall be:

 

(1)  At least 42 inches high;

 

(2)  Designed, constructed and erected to prevent overturning or climbing by riders or spectators;

 

(3)  Constructed so as to prevent passage of a sphere or round object 4 inches in diameter through all openings; and

 

(4)  Grounded in accordance with NFPA 70, National Electric Code, 2017 edition published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10.

 

          (f)  Notwithstanding the requirements of (a) above, fencing manufactured before January 1, 1993 and attached to the carnival or amusement ride by the manufacturer may remain in service.

 

          (g)  Notwithstanding the requirements of (a) above, if a ride is not designed to be fenced, a certification from the manufacturer that states “No fence required” shall be kept in the ride file jacket.

 

          (h)  Carnival or amusement rides in a fixed location shall be permitted to use, in lieu of fencing, existing physical characteristics which prevent unpermitted intrusion, after an inspection is conducted pursuant to Saf-C 1406.01.

 

          (i)  For the purpose of (h) above, “physical characteristics” includes trees, shrubs and water.

Saf-C 1402.10  Electrical Wiring.

 

(a)  Under the authority provided by RSA 321-A:2, the commissioner hereby adopts as a rule, the National Electrical Code, NFPA 70, 2017 edition, published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10.

 

(b)  All electrical wiring associated with any carnival or amusement ride shall comply with all relevant provisions of said code.

 

(c)  All generating plants shall be designed and maintained in accordance with the provisions of the National Electrical Code, NFPA 70, 2017 edition, published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10.  Each plant shall be individually identified by a unique identification number.

 

(d)  All generators shall be inspected and certified annually by a licensed New Hampshire electrician to comply with the National Electrical Code, NFPA 70, 2017 edition, or listed by a third party testing agency published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10. This certification shall contain the unique identification number required in (c) above and shall remain with the generator and be presented in hand to any authorized agent of the commissioner upon request.

 

(e)  All distribution boxes shall be designed and maintained in accordance with the provisions of the National Electrical Code, NFPA 70, 2017 edition, published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10.  Each box shall be individually identified by a unique identification number.  All distribution boxes shall be individually certified by a third party testing agency or a licensed New Hampshire electrical engineer.

          (c)  The requirement in (a) above shall pertain to all aspects of each carnival or amusement ride including but not limited to, all of the following:

(4)  Power conversion;

 

(5)  Governors;

 

(6)  Speed limiters;

 

(7)  Signal systems;

 

(8)  Restraining devices;

          Saf-C 1403.02  Structural Analysis and Design.

 

          (a)  In the event that designs are not available from a manufacturer or fabricator of a device, the operator shall furnish a structural analysis to the department.  A structural analysis shall consist of a written statement by an individual designated by the department, qualified by skill and experience, to conduct an analysis of the carnival or amusement ride or associated electrical equipment.

 

          (b)  For the purposes of this section, qualified by skill and experience means that the individual possesses a professional engineering degree in the specific area(s) being addressed by the design, and has completed an actual inspection while accompanied by an agent of the commissioner, to determine attention to detail, completeness of inspection, and proper procedure.

 

          (c)  Designs of a device or a structural analysis shall be required for carnival or amusement rides that the agents are unfamiliar with.

 

          (d)  Notwithstanding (b) above, challenge courses and zip lines shall be designed and approved in conformance with standards set forth in the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B.

          (b)  If the manufacturer’s instructions for maintenance are not available, the carnival or amusement ride shall be maintained in a manner which will prevent the carnival or amusement ride from being hazardous to any user, operator, or spectator.

 

          (c)  The responsibility for proper maintenance shall rest with the owner or operator.

 

          (d)  Maintenance of challenge courses or zip lines shall conform to the standards set forth in the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B.

          Saf-C 1404.02  Daily Inspection Required.

 

          (a)  An operator shall be responsible for inspection and repair of a carnival or amusement ride each day before a carnival or amusement ride is opened to receive passengers.

 

          (b)  The inspection required by this section shall include but not be limited to all of the following:

 

(1)  Safety belts, bars, locks, and other passenger restraints;

 

(2)  All automatic and manual safety devices;

 

(3)  Signal systems, brakes, and control devices;

 

(4)  Safety pins and keys;

 

(5)  Fencing, guards, barricades, stairways, and ramps;

 

(6)  Structure and moving parts;

 

(7)  Tightness of bolts and nuts;

 

(8)  Blocking, support braces, and jackstands;

 

(9)  Electrical equipment;

 

(10)  Lubrication as per manufacturer's instruction;

 

(11)  Hydraulic and pneumatic equipment;

 

(12)  Visual inspection of entrances, exits, stairways, ramps, and walkways;

 

(13)  Functional test of all communications equipment necessary for the operation of the ride;

 

(14)  Visual inspection of the ride structure;

 

(15)  The carnival or amusement ride shall be observed operating for a complete cycle;

 

(16)  All items not listed above yet included in the manufacturer's daily inspection checklist;

 

(17)  Inspection of these items shall be conducted in accordance with procedures and methods prescribed by the manufacturer; and

 

(18)  Documentation of the grounding conductor continuity assurance as required by Article 525.32 of the National Electrical Code, NFPA 70, 2017 edition, published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10.

 

          (c)  Inspections required by this section shall be documented in writing on a daily basis.  Written reports shall be kept with the carnival or amusement ride inspected and shall be kept at the location of the carnival or amusement ride in the ride file jacket.

 

          (d)  For the purpose of (c) above, ”kept with the ride” means that the report is in the ride file jacket and is located on the grounds of the fair, carnival or park.

 

          (e)  All written reports required by this section shall be completed on a form which includes at minimum the information in (f) below.

 

(f)  Reporters shall supply on the form in (e) above the following information:

 

(1)  Date of inspection;

 

(2)  Name or description of carnival or amusement ride inspected;

 

(3)  Name and job title of person performing the inspection;

 

(4)  Certification by the person performing the inspection that all of the requirements set forth in paragraph (b) have been met;

 

(5)  For the documentation required by (b)(18) above, clear identification of what components have been tested;

 

(6)  Signature of person performing the inspection; and

 

(7)  Whether each of the items listed in (b) above were performed in a satisfactory or unsatisfactory manner or were not applicable.

 

          (g)  To ensure compliance, all written reports required by this rule shall be made available to any authorized agent of the commissioner upon request.  No owner, operator, or employee thereof shall refuse or fail to provide such agent with said report(s), nor refuse to allow such agent to take said report(s) in hand for inspection.  The owner/operator of a relocatable carnival or amusement ride shall comply with RSA 321-A:2-a relative to weekly submission of inspection reports which are described herein.

 

          (h)  All written reports required by this rule shall be kept by the owner or operator for a period of 2 years, pursuant to RSA 321-A:2-a, I(a)(4), following the date of inspection.

          Saf-C 1404.021  Ride File Jacket.

 

          (a)  Each carnival or amusement ride shall have a current ride file jacket.

 

          (b)  The file shall be kept on the grounds where the carnival or amusement ride is being operated.

 

          (c)  The ride file jacket shall contain:

 

(1)  The non-destructive test report on the testing contractor’s official letterhead;

 

(2)  The name of the carnival or amusement ride, the manufacturer and date of manufacture;

 

(3)  Maintenance records;

 

(4)  Operator training records;

 

(5)  Alteration records;

 

(6)  Ride serial number, and in the case of a homemade ride or device, a serial number assigned by the agent of the commissioner and any information identifying such carnival or amusement ride and its manufacturer, and documentation regarding non-destructive testing requirements;

 

(7)  Daily check lists;

 

(8)  Agent of the commissioner's reports;

 

(9)  Listing certification of distribution boxes by third party inspection agency or New Hampshire licensed electrical engineer, as applicable;

 

(10)  Listing certification of each generator by third party inspection agency or annual certification letter from New Hampshire licensed electrician for each generator as required in Saf-C 1402.10(d);

 

(11)  The manufacturer’s English-language owner or operator’s manual or, in the case of a homemade ride, air supported structure, carnival or amusement attraction, an owner or operator’s manual prepared by a state licensed engineer; and

 

(12)  Records of the continuity assurance testing that is required in Article 525.32 of the National Electric Code, NFPA 70, 2017 edition published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10.

 

          (d)  The ride file jacket shall be presented to the agent of the commissioner upon his or her request.

          (b)  Themselves;

 

          (c)  Any employee of the owner or operator of the carnival or amusement ride; and/or

 

          (d)  The carnival or amusement ride.

          Saf-C 1404.04  Operator's Authority.

 

          (a)  The physical operator of a carnival or amusement ride shall refuse admission to any carnival or amusement ride, or if admitted on a carnival or amusement ride shall remove, any person who is acting in a manner that might cause or contribute to the injury of himself or others.

 

          (b)  The reasons for said refusal or removal shall include, but not be limited to, all of the following conditions that interfere with public safety:

 

(1)  Drunkenness;

 

(2) Drug abuse;

 

(3)  Refusal to obey rules posted by the operator for the safe use of the carnival or amusement ride; and

 

(4)  Behavior which interferes with the safe operation of a carnival or amusement ride.

PART Saf-C 1405  OPERATION

 

          Saf-C 1405.01  Operational Requirements.

 

          (a)  Carnival or amusement rides shall be operated only after the requirements of RSA 321-A and these rules have been met.  The carnival or amusement rides shall be operated only by personnel certified by the owner or operator to be competent, experienced, and instructed in the operation of the carnival or amusement ride(s) which they are responsible for operating.  This certification shall be kept in the ride file jacket.

 

          (b)  Except in an emergency, no person shall operate a carnival or amusement ride until that person has been authorized to engage in such operation.  Such authorization shall be given only by the owner or operator of the carnival or amusement ride.

 

          (c)  The responsibility for the safe operation of all carnival or amusement rides shall rest with the owner/operator.

          Saf-C 1405.02  Operator Required.

 

          (a)  Staffing of operators and attendants shall be in conformance with manufacturer’s requirements.

 

          (b)  In the event that original manufacturer staffing information is not available, staffing of operators and attendants shall be as follows:

 

(1)  There shall be one authorized operator on site for each carnival or amusement ride in operation; and

 

(2)  The operator shall attend his or her assigned carnival or amusement ride and no other while the carnival or amusement ride is in operation.

          Saf-C 1405.03  Disconnect Switch Required.

 

          (a)  Every portable carnival or amusement ride shall be equipped with a means to disconnect each structure from all ungrounded conductors as provided by Article 525.21(A) of the National Electrical Code, NFPA 70, 2017 edition published by the National Fire Protection Association (NFPA), as adopted pursuant to RSA 155-A:1 and as amended by the building code review board and ratified by the legislature in accordance with RSA 155-A:10.

 

          (b)  The disconnect switch shall be maintained in good working order at all times, and shall not be bypassed or in any way rendered inoperable during operation of the carnival or amusement ride to which it is attached.

          Saf-C 1405.04  Accident Procedure.

 

          (a)  All operators of carnival or amusement rides shall adhere to the procedures set forth in this section regarding accidents.

 

          (b)  A carnival or amusement ride shall be immediately closed and the commissioner or his agent notified within one hour upon the occurrence of an accident which:

 

(1)  Causes the death of any person as a result of a defect in the design of the carnival or amusement ride, operator error, malfunction, or the rider's fault;

 

(2)  Causes serious injury that indicates that the safety of future users of the carnival or amusement ride might be in jeopardy, as a result of a defect in the design of the carnival or amusement ride, operator error, malfunction, or the rider's fault;

 

(3)  Causes injury to any person, where the injury requires the admission of the injured person to a hospital, or otherwise results in the injured person being treated at a hospital either on an inpatient or outpatient basis; or

 

(4)  Causes damage to the carnival or amusement ride or to any of its component systems which would affect the safety of the carnival or amusement ride.

 

          (c)  When a carnival or amusement ride has been closed, in accordance with paragraph (b), the carnival or amusement ride shall remain closed until the department has completed its investigation of the accident.

 

          (d)  The department's investigation shall focus on the cause of the accident, such as:

 

(1)  Patron error;

 

(2)  Operator error; or

 

(3)  Mechanical error.

 

          (e) The commissioner or his authorized representative shall issue an order expressly granting permission to reopen said carnival or amusement ride at the conclusion of the investigation.

 

          (f)  The following shall apply when a carnival or amusement ride has been closed, in accordance with paragraph (b):

 

(1)  The carnival or amusement ride shall not be removed from the site of the incident until a written release has been granted by the commissioner or his authorized representative at the conclusion of the investigation;

 

(2)  Prior to such approval, neither the carnival or amusement ride itself, nor the surrounding area shall be disturbed, cleaned up, or altered;

 

(3)  The provisions of this paragraph shall not apply when action contrary to the requirements set forth herein is necessary for the preservation of life, the removal of injured persons or bodies, the preservation of property, or to permit the flow of traffic.

 

          (g)  A carnival or amusement ride that should have been closed after an accident but continued to operate until it was ordered closed, in accordance with paragraph (b), shall not be moved from the site of the accident until a written release has been granted by the commissioner or his authorized representative at the conclusion of the investigation.

 

          (h)  The following shall apply pending the receipt of the written release by the commissioner or his authorized agent, in accordance with paragraph (g):

 

(1)  Prior to receiving the written release, neither the carnival or amusement ride itself, or the surrounding area shall be disturbed, cleaned up, or altered; and

 

(2)  The provisions of this paragraph shall not apply when action contrary to the requirements set forth herein is necessary for the preservation of life, the removal of injured persons or bodies, the preservation of property, or to permit the flow of traffic.

 

          (i)  A written accident report shall be sent by the operator to the commissioner within 5 days of any accident on a "Amusement Ride Accident Report" form furnished by the division.

 

          (j)  The operator shall supply on the amusement ride accident report the following information:

 

(1)  Date of the report;

 

(2)  Registration number;

 

(3)  Name of amusement ride;

 

(4)  Time and exact location of accident;

 

(5)  Name and address of persons killed or injured;

 

(6)  Weather conditions;

 

(7)  Name and address of the physical operator in charge;

 

(8)  Attendant or attendants at time of accident and their names and addresses;

 

(9)  Type of carnival or amusement ride on which the accident occurred;

 

(10)  Description of the accident;

 

(11)  Operator's opinion as to the cause of the accident;

 

(12)  Known witnesses and their names and addresses;

 

(13)  Whether carnival or amusement ride is registered;

 

(14)  Whether the carnival or amusement ride had been inspected, pursuant to Saf-C 1404.02, and if so, the:

 

a.  Date of last inspection; and

 

b.  Name and address of the agent;

 

(15)  Whether safety devices required by Saf-C 1400 were installed;

 

(16)  Name of hospital/doctor where injured taken;

 

(17)  Whether first aid equipment was available at the scene of the accident;

 

(18)  Detailed description of mechanical failure; and

 

(19)  Signature of operator.

 

          (k)  The operator shall maintain copies of accident reports involving any injury that occurs, at the location of the carnival or amusement ride, for a period of 3 years from the date of the incident.  These reports shall be open to the inspection of the commissioner or his agent during normal business hours.

          Saf-C 1405.05  Inspection Permitted.

 

          (a)  The issuance of a registration decal shall allow any authorized agent of the commissioner free access to the carnival or amusement rides to which the decal is issued, as well as to the grounds upon which the carnival or amusement ride is located, when the agent is performing the duties relating to the carnival or amusement ride.

 

          (b)  In order to keep the commissioner informed regarding the operation of relocatable carnival or amusement rides, the owner or operator of such carnival or amusement rides shall submit, with the required registration materials, a tentative itinerary providing dates and locations of expected operation in the state of New Hampshire.  Throughout the operating season, this itinerary shall be updated through submission of notices as to additional operating periods or locations as soon as practicable but prior to operation.

          Saf-C 1405.06  Insurance Coverage Required.

 

          (a)  Where the insurance contract held by a carnival or amusement ride owner or operator as required in RSA 321-A, expires or is canceled, notice shall be furnished to the commissioner by the insurance carrier not less than 10 days prior to said expiration or cancellation.

 

          (b)  All carnival or amusement rides covered by an insurance contract shall be closed no later than the date of expiration or cancellation of the contract.  Carnival or amusement rides shall remain closed until the requisite insurance, pursuant to RSA 321-A:5, III, is re-obtained and is in effect and the department of safety has been notified in writing.

          Saf-C 1405.08  Periodic Testing.

 

          (a)  All carnival or amusement rides that have life supporting spindles, shafts or supplementary spindles shall be tested in accordance with this section by a method of non-destructive testing.

 

          (b)  Non-destructive testing shall be performed by qualified testing firms and a copy of certification of successful completion of said testing shall be filed with the division.

 

          (c)  Non-destructive testing shall be conducted as follows:

 

(1)  Testing shall be performed in accordance with the manufacturer’s instructions;

 

(2)  If the manufacturer of the carnival or amusement ride has no requirements pertaining to non-destructive testing, or if the carnival or amusement ride is homemade or has been so altered that the manufacturer will no longer accept it as its product, an engineer approved by the commissioner shall determine:

 

a.  The areas of the carnival or amusement ride to be tested;

 

b.  The method of non-destructive testing to be used; and

 

c.  The frequency of such testing;

 

(3)  Testing shall be conducted by an independent and qualified testing agency in accordance with the standards set forth in the 8th edition of the ASTM Standards on Amusement Rides and Devices, further described in Appendix B; and

 

(4)  Testing by a carnival or amusement ride owner or manager shall not be acceptable.

 

          (d)  All manufacturer safety requirements pertaining to the operation of the carnival or amusement ride shall be followed during non-destructive testing.  The commissioner shall set additional safety requirements if necessary to protect life.

          Saf-C 1406.01  Inspection Required.

 

          (a)  Prior to operation of any carnival or amusement ride for the general public, the operator shall have the carnival or amusement ride inspected by an agent of the commissioner pursuant to RSA 321-A:2-a and RSA 321-A:5, III.

 

          (b)  Pursuant to RSA 321-A:2-a, operators of fixed location carnival or amusement rides shall have their carnival or amusement rides inspected at the following times:

 

(1)  Within 15 days of the expected date of operation each season;

 

(2)  After the carnival or amusement ride has been disassembled and reassembled;

 

(3)  After receipt of inspection reports submitted by the operator; and

 

(4)  At unannounced times.

 

          (c)  Pursuant to RSA 321-A:2-a, operators of relocatable carnival or amusement rides shall have their carnival or amusement rides inspected at the following times:

 

(1)  When first assembled in New Hampshire, and annually, thereafter;

 

(2)  After receipt of inspection reports submitted daily by the operator; and

 

(3)  At unannounced times.

          Saf-C 1408.01  Registration Form.

 

          (a)  All persons required to register a carnival or amusement ride pursuant to RSA 321-A:5, shall make application for said registration to the division upon the "Carnival or Amusement Ride Registration Form".

 

          (b)  The applicant shall supply all of the following information on the form:

 

(1)  The owner or operator's name, address, telephone number, business license number or other identification number, and date of birth;

 

(2)  Business name, address, and telephone number of carnival or amusement ride company;

 

(3)  Name and make of such carnival or amusement ride to be registered, as well as:

 

a.  Serial number of each such carnival or amusement ride;

 

b. If no serial number appears on the carnival or amusement ride, a number shall be assigned by the owner or insurer in order to allow a positive identification; and

 

(4)  A copy of the operator's annual inspection form, which shall include the following:

 

a.  Name of business;

 

b.  Name of owner/operator;

 

c.  Address and telephone number;

 

d.  Type of carnival or amusement ride;

 

e.  Manufacturer and serial or ID number;

 

f.  Inspection information, such as, passed or needs repair;

 

g. Certification that the owner/operator has inspected all of the listed carnival or amusement rides and that each complies with the rules and RSA 321-A and that the carnival or amusement rides are safe to operate for the public, unless noted in the inspection information column; and

 

h.  Date and signature of owner/operator.

 

          (c)  The applicant shall include with the application the required fee of $130.00 per carnival or amusement ride, pursuant to Saf-C 1408.03.

          (a)  Pursuant to RSA 321-A:5, I, the annual registration fee for a carnival or amusement ride shall be $130.00 which shall include the decal fee authorized by RSA 321-A:4.

 

          (b)  The registration fee shall be paid for each carnival or amusement ride registered.

 

          (c)  Each registration shall be valid from January to December of each calendar year.

          Saf-C 1409.01  Notice.

 

          (a)  In any case in which a suspension of operation is ordered by the commissioner or his authorized agent pursuant to RSA 321-A:7, the written notice required by that statute shall be issued on the "Notice of Suspension" form.

 

          (b)  The form shall include all of the following:

 

(1)  The owner or operator's name;

 

(2)  Date of issuance;

 

(3)  Order to cease operation;

 

(4)  Identification of carnival or amusement rides covered by such order;

 

(5)  Notification that the carnival or amusement ride shall remain closed until permission to reopen is expressly granted by the commissioner or his agent;

(8)  Affidavit of service which shall include:

          Saf-C 1410.05  Bungee Cord Requirements.

 

          (a)  Bungee cords shall be equipped with non-metallic connectors and either bungee cord covers or cord sleeves.  The operating length of a bungee cord at its maximum designed dynamic load shall not exceed 4 times its unloaded length.

 

          (b)  The cord and its non-metallic connectors shall be discarded and no longer used for bungee jumping when one of the following occurs:

 

(1)  Exposure to daylight exceeds 250 hours, unless the cord cover or sleeve fully protects all of the cord from visible and ultra-violet exposure;

 

(2)  6 months have passed from the date of manufacture;

 

(3)  Threads exhibit wear, such as bunched threads, uneven tension between threads or thread bands;

 

(4)  Broken threads in excess of 5%;

 

(5)  Contact with solvents or corrosive or abrasive substances;

 

(6)  When the strength of the cord is reduced to less than the maximum designed dynamic load;

 

(7)  After a maximum of 500 jumps using that cord;

 

(8)  When the cord or its connectors are not in compliance with the manufacturer's specifications; or

 

(9)  Any other flaws are found that impact the cord’s safety.

 

          (c)  No cord shall be used for successive jumps.  At least 5 minutes shall lapse between jumps with a particular cord, to allow the cord to fully return to its original unloaded length.

 

          (d)  Bungee cords shall be examined daily.  Before starting the day's operations, the jump master shall visually inspect the entire length and circumference of the bungee cord for signs of wear.  The inspection shall be repeated at least 4 times during daily operation and recorded in the site log.

 

          (e)  When unexpected changes in bungee cord performance occur, the bungee cord shall be replaced immediately.

          Saf-C 1410.12  Landing/Recovery Area Including the Area Immediately Under the Jump Space.

 

          (a)  The following requirements shall apply where the jump space and landing area is over land:

 

(1)  A safety net, landing pad, or air bag shall be used;

 

(2)  The safety net, landing pad, or air bag shall:

 

a.  Be designed to provide coverage of the jump zone; and

 

b.  Be rated for the maximum free fall height possible from the platform during operation;

 

(3)  The safety net, landing pad or air bag shall be in position before jumper preparation commences on the platform;

 

(4)  Upon completion of a jump, the jumper shall be lowered onto the safety net, air bag, or landing pad;

 

(5)  The landing area shall be free of spectators at all times;

 

(6)  The area shall be free of any equipment or staff when a jumper is being prepared on the jump platform and until the bungee cord is at its static extended state; and

 

(7)  A place for the jumper to sit and recover shall be provided close to, but outside the landing area.

 

          (b)  The following requirements shall apply where the jump space and landing area is over a body of water:

 

(1)  A vessel shall be positioned to recover jumpers;

 

(2)  If the vessel is docked or moored, one person may operate the landing vessel and assist the jumper to land;

 

(3)  If the vessel is not docked or moored, one person shall pilot the vessel and one person shall assist the jumper to land;

 

(4)  The vessel shall be equipped with Coast Guard approved life jackets and rescue equipment;

 

(5)  The vessel operators shall wear life jackets; and

 

(6)  The jump space and landing area shall be free of other vessels, floating objects, known submerged objects, the public, and any spectators.

 

          (c)  When the landing area is a swimming pool, the following shall apply:

 

(1)  The swimming pool size shall at a minimum be 9 feet deep and cover the entire landing area;

 

(2)  Rescue equipment shall be available;

 

(3)  The jump space and landing area shall be secured:

 

(4)  Only the operators of the bungee jump shall be within the jump space and landing areas; and

 

(5)  The landing area shall be enclosed by a fence, which shall be designed and constructed to prevent people, animals, and objects from entering the landing area.

          (b)  There shall be a public address system capable of operation during all hours of business.  There shall be a telecommunication link between the platform and the landing area.

 

          (c)  There shall be a means of telecommunication within 200 feet of the operation to local emergency services.

 

          (d)  Jumps shall only be conducted under the direct control of a jump master.

 

          (e)  Adjustments for the weight of each jumper shall be made by the jump master's selection of bungee cord and length of webbing or rope attached to the bungee cord.

 

          (f)  A sign shall be erected at the place of jumper registration listing the age restrictions for jumpers.  The sign shall be clearly visible.

          Saf-C 1410.16  Staff and Duties.

 

          (a)  The minimum age for staff shall be 21.

 

          (b)  To qualify as jump master for a bungee jumping site, a person shall supervise 500 complete jumps under supervision of a jump master and have complete knowledge of all aspects of the operation.  The jumps shall be documented and shall indicate the date, time and location of the jump. Documentation shall be available for inspection during reasonable business hours.

 

          (c)  The staff of a bungee jumping operation shall include at least 4 persons, with the following responsibilities:

 

(1)  The jump master who shall:

 

a.  Have control over the operation and shall be responsible and accountable for the operation of the site;

 

b.  Take the jumper through the final stages of preparation to the jump take-off;

 

c.  Be responsible for the training of other staff and shall have a thorough knowledge of the site, equipment, procedures and staff; and

 

d.  Be responsible for checking selection of the bungee cord and adjusting the rigging at each jump platform;

 

(2)  The jump operator who shall:

 

a.  Assist the jump master to prepare the jumper;

 

b.  Assist the jumper into harnesses, safety belts, attach the jumper to rigging;

 

c.  Operate the lowering system; and

 

d.  Carry out landing/recovery operator duties and assist in controlling the public;

 

(3)  The landing operator who shall assist:

 

a.  The jumper to land on the landing pad or air bag;

 

b.  The jumper to the recovery area; and

 

c.  In controlling the public; and

 

(4)  The registration clerk's duties shall include:

 

a.  Registration of the jumper;

 

b.  Weighing of the jumper;

 

c.  Controlling movement of a jumper to the jump platform; and

 

d.  Controlling or assisting to control the public.

          (b)  A first aid kit which meets or exceeds OSHA standard 1910.151, stretcher, back board, and blankets shall be maintained on site.

 

          (c)  All jump masters shall have current first aid certification by the Red Cross and complete an annual refresher course sponsored by the Red Cross.

 

          (d)  At sites where the jump or recovery is over water, the jump master and all landing staff shall be holders of a current Red Cross life saving certificate and shall have passed the equivalent for in-water rescue of spinal injuries or unconscious patients.

 

          (e)  Emergency lighting shall be provided at all jump sites and shall operate ½ hour prior to sunset until ½ hour after sunrise.  The emergency lighting system shall illuminate the jump platform, the jump space, and the landing area.

          Saf-C 1411.01  Operator Duties.

 

          (a)  Each operator shall:

 

(1)  Except as otherwise required by Saf-C 1402.01(c), construct, install, maintain, and operate each challenge course or zip line in accordance with the standards set forth in the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B;

 

(2)  Ensure that each challenge course or zip line is inspected, at least once each year, by a qualified person, as defined in the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B, and found to be in safe condition;

 

(3)  Train employees for each challenge course or zip line in accordance with the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B;

 

(4)  Procure and maintain insurance pursuant to RSA 321-A:5 and Saf-C 1405.06;

 

(5)  Retain all records pertaining to inspections and maintenance for a period of 2 years in accordance with RSA 321-A:2-a, I(a)(4); and

 

(6)  Comply with the accident procedures set forth in Saf-C 1405.04.

          Saf-C 1411.02  Operator Conduct.  All persons operating or otherwise using a challenge course or zip line shall conduct themselves in a manner which will not endanger:

 

          (a)  Any other person operating, riding on, or otherwise using said challenge course or zip line, or any other challenge course or zip line;

 

          (b)  Themselves;

 

          (c)  Any employee of the owner or operator of the challenge course or zip line; or

 

          (d)  The challenge course or zip line.

          Saf-C 1411.03  Operator Authority.

 

          (a)  The physical operator of a challenge course or zip line shall cease operation of the challenge course or zip line, in a manner that does not endanger the safety of any person operating, riding on, or using the challenge course or zip line, in the event that any such person is acting in a manner that might cause or contribute to the injury of the person or others. The operator shall not recommence operation of the challenge course or zip line until the circumstances justifying the cessation of operations is resolved.

 

          (b)  The circumstances justifying the cessation of operations described in (a) above shall include, but not be limited to, all of the following conditions that interfere with public safety:

 

(1)  Drunkenness;

 

(2)  Drug abuse;

 

(3)  Refusal to obey rules posted by the operator for the safe use of the challenge course or zip line;

 

(4)  Engaging in any challenge course or zip line without the authority, supervision, and guidance of the operator and his or her employees;

 

(5)  Dropping, throwing, or expelling any object from the challenge course or zip line, unless authorized to do so by the operator or his or her employees;

 

(6)  Performing any act that interferes with the safe operation of a challenge course or zip line; or

 

(7)  Engaging in any harmful conduct or willfully or negligently engaging in any conduct that might cause or contribute to the injury of any person or damage to the challenge course or zip line.

          Saf-C 1411.04  Registration.

 

          (a)  Each challenge course or zip line shall be registered, pursuant to the requirements set forth in  Saf-C 1408, by completing and submitting a “Challenge Course/Zip Line Registration” form (rev. 8/18) and a “Challenge Course/Zip Line Operator’s Annual Inspection Report” form (rev. 8/18).

 

          (b)  A qualified person, in accordance with the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B, shall submit an inspection report, each year, as part of registration, that demonstrates that all elements of the challenge course or zip line are in accordance with the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B, and shall certify the following by the qualified person’s signature, printed name and date on the “Challenge Course/Zip Line Operator’s Annual Inspection Report” form (rev. 6/18): “I certify that all elements of the challenge course(s) or zip line(s) listed above are in accordance with the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016)”.

 

          (c)  The qualified person conducting the inspection and making the certification required by Saf-C 1411.04(b) above shall attach his or her inspection report(s) to the “Challenge Course/Zip Line Operator’s Annual Inspection Report” form upon which he or she has made his or her certification.

 

          (d)  For registration purposes, each set of contiguous elements shall represent a single course and be considered a single ride or device subject to the requirements of Saf-C 1408.03.

          (a)  Agents of the commissioner shall be subject to the standards set forth in the 16th edition of the ANSI/ACCT Challenge Courses and Canopy/Zip Line Tours Standards (2016), available as noted in Appendix B.

 

          (b)  In addition to (a) above, agents of the commissioner shall be granted free access to any challenge course or zip line pursuant to Saf-C 1405.05 and shall be authorized to conduct inspections at any reasonable time, with or without prior notice.
