CHAPTER Saf-C 3000  HARDSHIP REGISTRATION

PART Saf-C 3001  PURPOSE AND SCOPE

 

          Saf-C 3001.01  Purpose.

 

          (a)  The purpose of these rules shall be to set forth the administrative requirements to implement the provisions of RSA 261:180, IV,  providing hardship registrations for vehicles registered to a person whose license has been suspended or revoked.

 

          (b)  The purpose of a hardship registration shall be to allow a vehicle to be operated by a spouse or other person with a valid license, when, without such a registration, a hardship would be placed  upon a spouse or other person.

          Saf-C 3001.02  Scope.  Any person whose motor vehicle registration has been suspended or

revoked pursuant to RSA 261:180, III shall be eligible to apply for a hardship registration.

PART Saf-C 3002  DEFINITIONS

 

          Saf-C 3002.01  “Complaint” means a written statement submitted by a person, association, partnership, corporation, state agency or other legal entity that sets forth specific allegations and requests administrative action by the department.

          Saf-C 3002.06  “Hardship registration” means a registration issued for a motor vehicle when  the owner’s privilege to register said motor vehicle has been suspended or revoked pursuant to RSA 261:180, III.

PART Saf-C 3003  GENERAL ADMINISTRATION

 

          Saf-C 3003.01  Persons Qualified for A Hardship Registration.  In order to qualify for a hardship registration, a person shall have been:

 

          (a)  Certified as an habitual offender;

 

          (b)  Convicted of negligent homicide involving the use of a motor vehicle;

 

          (c)  Convicted of manslaughter involving the use of a motor vehicle;

 

          (d)  Convicted of a subsequent offense of driving under the influence of intoxicating liquor or any controlled drug pursuant to RSA 265:82; or

 

          (e)  Convicted of aggravated driving while intoxicated pursuant to RSA 265:82-a.

          Saf-C 3003.02  Hardship Registration Notice.

 

          (a)  Upon receipt of an abstract of conviction of an offense set forth in Saf-C 3003.01(b) - (e) or an habitual offender certification order, the financial responsibility administrator shall issue a notice to the person whose license is under suspension or revocation.

 

          (b)  The notice shall include the following information:

 

                  (1)  All registrations issued in the person’s name shall be suspended in 30 days;

 

                  (2)  All registration plates shall be forwarded to the department at the conclusion of the 30 day period, unless a hardship registration has been obtained within the 30 day period;

 

                  (3)  The procedure for obtaining a hardship registration;

 

                  (4)  In the event a hardship registration is requested within 30 days, the person’s existing registration plates shall be used and if more than 30 days have passed, a new registration plate shall be issued upon payment of the appropriate fee; and

 

                  (5)  A statement that the person shall be required to present the registration suspension notice to the department, if a hardship registration shall be requested, in order to prove that he/she is qualified, pursuant to RSA 261:180, III, to obtain a hardship registration.

          Saf-C 3003.03  Procedure to Obtain A Hardship Registration.

 

          (a)  A person whose privilege to register any motor vehicle has been suspended or revoked pursuant to RSA 261:180, III may obtain a hardship registration by mailing or by providing in person at the registration section of the department the following:

 

                  (1)  The registration form(s) for the vehicle(s) that are subject to suspension;

 

                  (2)  The notice or a copy thereof, sent by the department, indicating that the person’s registration privileges are scheduled to be revoked and that a hardship registration is available; and

 

                  (3)  The $10 fee, pursuant to RSA 261:180, IV, for each registration converted to a hardship registration.

 

          (b) Upon receipt of the information set forth in (a) above, the department shall issue a hardship registration to the person.

          Saf-C 3003.04  Renewal of A Hardship Registration.

 

          (a)  Each hardship registration shall be renewed by the vehicle owner during his/her birth month.

 

          (b)  Prior to renewing a hardship registration, the vehicle owner shall obtain the registration renewal from his/her town or city clerk, upon payment of the appropriate fees.

 

          (c)  Each hardship registration shall be renewed by mailing the information, or by appearing in person at the registration section of the department.

 

          (d)  The requirements set forth in Saf-C 3003.03 shall be followed for registration renewal.

          Saf-C 3003.05  Failure to Renew A Hardship Registration.  Any person who does not renew a hardship registration shall surrender his/her registration plates to the department within 30 days of the date of expiration.

          Saf-C 3003.06  Restoration of Registration Privileges.

 

          (a) Each hardship registration shall be converted to a regular registration in the event the vehicle

owner submits the following to the registration section of the department:

 

                  (1)  A letter from the director of motor vehicles demonstrating that the person’s driver license and privilege to register any motor vehicle has been restored;

 

                  (2)  A receipt indicating that all restoration fees have been paid; and

 

                  (3)  The hardship registration form.

          Saf-C 3003.07  Revocation of A Hardship Registration.

 

          (a)  Upon receipt of evidence indicating that a person, who has obtained a hardship registration for his/her vehicle, has operated said vehicle, the bureau of hearings shall provide an opportunity for a hearing for the person to appear in order to show cause why the hardship registration should not be revoked.

 

          (b) After the opportunity for a hearing, a hearings examiner shall revoke the person’s hardship registration if it is determined that the person operated the vehicle.

 

          (c)  In the event a person’s hardship registration is revoked, he/she shall not be able to obtain another hardship registration during the remaining period of time that his/her license and registration privileges have been suspended or revoked for the offenses set forth in RSA 261:180, III.

          Saf-C 3003.08  Obtaining a Hardship Registration After Registration Plates Have Been Returned to the Department. 

 

          (a)  Any person who qualifies for a hardship registration, and requests it after his/her registration plates have been returned to the department, shall:

 

                  (1)  Comply with the requirements set forth in Saf-C 3003.03; and

 

                  (2)  Pay the appropriate registration plate fee.

          Saf-C 3003.09  Registrations Subject to Suspension or Revocation. In the event a person’s

registration privileges are suspended or revoked pursuant to RSA 261:180, III, all registrations, on which the person’s name appears, shall be suspended or revoked.

          Saf-C 3003.10  Leased Vehicles.

 

          (a)  Any person with a leased vehicle shall be able to obtain a hardship registration.

 

          (b)  The hardship registration shall be issued in the name of the leasing company and in the name of the person whose registration privileges have been suspended or revoked pursuant to RSA 261:180, III.

          Saf-C 3003.11  Hardship Registration and Title.  The issuance of a hardship registration shall have no affect on the status of the title of the vehicle.

          Saf-C 3003.12  Sale of Vehicle with A Hardship Registration.

 

          (a)  A hardship registration shall be terminated in the event the vehicle is sold and the owner does not purchase another vehicle.

 

          (b)  A hardship registration may be transferred from one vehicle to another in the event the owner sells or trades in the vehicle and immediately purchases a different vehicle.

 

          (c)  A hardship registration shall not prohibit the registrant from selling his/her vehicle.

          Saf-C 3003.13  Hardship Registration Obtained in Bad Faith.

 

          (a)  Any hardship registration obtained in a manner contrary to the provisions of  RSA 264:24-b shall be revoked.

 

          (b)  The administrative hearing provisions set forth in Saf-C 3003.07 shall apply to the revocation.

          Saf-C 3003.14  Limitation.

 

          (a)  A person who qualifies for a hardship registration shall be able to obtain a hardship registration for the total number of vehicles on which his/her name appears on the registration form, if he/she requests.

 

          (b)  The owner of a vehicle whose license and registration privileges have been suspended or revoked shall not be authorized to operate the vehicle, despite the fact that a hardship registration has been obtained, until his/her license and registration privileges have been restored.
