CHAPTER Saf-C 5100  WATERCRAFT SAFETY OPERATING RESTRICTIONS

 

REVISION NOTE #1:

 

          Document #9953, effective 7-1-11, adopted Chapter Saf-C 5100 entitled “Watercraft Safety Operating Restrictions”, which is exempt from RSA 541-A pursuant to RSA 541-A:21, I(dd), effective 6-24-11, and RSA 270:12 relative to boat operating restrictions.  See also Chapter Saf-C 400 entitled “Watercraft Safety Rules” for rules in this area.

 

          Saf-C 5100 had formerly contained rules relative to the motor oil discharge cleanup fund, and was originally adopted in Document #6101, effective 10-24-95 as an interim rule, pursuant to RSA 21-P:14, V(q) and RSA 260:38, IV.  The filings of the Department of Safety affecting the former Saf-C 5100 on the motor oil discharge cleanup fund included the following documents:

REVISION NOTE #2:

 

          Document #10169, effective 8-8-12, which is exempt from RSA 541-A pursuant to
RSA 541-A:21, I(dd), readopted and renumbered many rules in Saf-C 402 on power boat restrictions as rules in Saf-C 5100 and readopted with amendment and renumbered Saf-C 402.92 as Saf-C 5102.100.  Document #10169 also adopted Saf-C 5102.89 on Trout Pond, renumbered Saf-C 5102.01 on Beaver Lake as Saf-C 5102.04, and renumbered Saf-C 5102.02 on Squam Lake as Saf-C 5102.81(j).

          Saf-C 5102.01  Back Lake.  No person shall operate a motorboat at a speed exceeding 10 miles per hour.  However, this restriction shall not apply between the hours of 12:30 p.m. and 3:30 p.m. daily on that portion of Back Lake in the town of Pittsburg, easterly of a line running from Washburn's Camp on the south to the New Hampshire Guides Lot on the north.

          Saf-C 5102.04  Beaver Lake.

 

          (a)  Notwithstanding any other rule to the contrary, no person shall operate a boat at a speed exceeding 10 miles per hour on Beaver Lake in the town of Derry. This restriction shall not apply between the hours of 1:00 p.m. and 7:00 p.m. daily, and further provided that during unrestricted hours no boat shall exceed 30 miles per hour at any time.

 

          (b)  All water skiing on Beaver Lake shall be in a counter-clockwise direction at all times.

(2)  The easterly point of the first island west thereof; and

 

(3)  Also on the northerly course between the easterly point of the island referred to in (2) above and the red and black buoys marking the northwest entrance to the channel.

          (a)  No person shall operate a vessel at a rate of speed exceeding 6 miles per hour in Squam River in the town of Holderness between the southerly end of the boat house in Little Squam Lake near the Holderness Bridge and the light buoy at the lower or westerly end of Squam Lake.

 

          (b)  No person shall operate a vessel at a rate of speed exceeding 6 miles per hour in Squam River in the town of Ashland.

          (g)  From June 15 to September 15, on Sunday between 9:30 a.m. and 12:30 p.m., that portion of Squam Lake in the channel between Chocorua Island, also known as Church Island, at light 5, and Merrill Island at light 6, shall be a “no wake” area.

 

          (h)  That portion of Squam Lake known as Rattlesnake Cove in the town of Sandwich shall be a “no wake” area.

 

          (i)  That portion of Squam Lake known as Squaw Cove in the town of Sandwich shall be a “no wake” area.

          (c)  That part of Alton Bay in Lake Winnipesaukee lying south of the line running east and west through the bandstand shall be a "no wake" area.  Commercial vessels operating in this area shall pass on the east side of the bandstand.

          Saf-C 5102.100  No Wake” Areas.  No person shall operate a motorboat upon public waters of the state in a "no wake" area in excess of the "no wake" speed as defined in RSA 270-D:1, VIII.
