CHAPTER Sw 4000  RULES OF NEW HAMPSHIRE HOT LOTTO

PART Sw 4001  NEW HAMPSHIRE HOT LOTTO GAME

 

          Sw 4001.01  Definitions.  The following definitions shall apply for the New Hampshire hot lotto game:

 

          (a)  "Agent" means an authorized sales outlet, authorized to sell lottery tickets.

 

          (b)  “Annuity payment” means the grand prize winner's jackpot share to be made on an annuitized basis over a period of 25 years.

 

          (c)  "Bet" means a combination of 5 different numbers between 01 and a designated number, and one additional hot ball number between 01 and a designated number, which appear on a ticket as a single lettered selection.

 

          (d)  "Bet slip" means a pre-printed piece of paper which contains 5 play panels with 2 sets of numbered squares between 01 and a designated number to be marked by the player.

 

          (e)  "Commission" means the New Hampshire lottery commission.

 

          (f)  "Designated number" means a pre-determined number specified by the multi-state lottery association that identifies the highest number available to be chosen in set 1 and set 2 of the bet slip.

 

          (g)  "Director" means administrative head appointed by the New Hampshire lottery commission to act on their behalf in the daily decision making process.

 

          (h)  "Drawing" means the process used to randomly select 5 different numbers between 01 and the designated number, plus one additional hot ball number between 01 and the designated number to determine the winning combination for a particular date.

 

          (i)  "Easy pick" means a hot lotto ticket with a selection of numbers randomly selected by a lottery on-line sales terminal.

 

          (j)  “Grand prize share” means the grand prize pool divided by the number of grand prize winning plays.

 

          (k)  "MUSL" means Multi-State Lottery Association.

 

          (l)  "New Hampshire hot lotto" means an on-line terminal lottery game administered by MUSL and offered for sale by the lottery commission, of which a player chooses 2 sets of numbers for a chance to win a prize amount on a given draw date.

 

          (m)  "On-line terminal" means a computer device authorized by the commission to function in an interactive mode with a central computer system, for the purpose of issuing lottery tickets and entering, receiving and processing lottery transactions.

 

          (n)  “Pari-mutuel” means the prize amount calculated for a prize category by dividing the amount of winning plays for the prize category into the amount of prize money available for the prize category.

 

          (o)  "Party states" means all member states of MUSL.

 

           (p)  “Ticket” means a slip of paper produced by an on-line terminal acknowledging the recording of a legal transaction between the lottery and the recipient for a certain date.

 

           (q)  "Winning numbers" means 5 randomly selected 2 digit numbers between 01 and a designated number, plus one additional number between 01 and a designated number, to determine the winning plays on a specific draw date.

          Sw 4001.02  Ticket Characteristics, Purchase and Restrictions.

 

          (a)  To purchase a hot lotto ticket, an individual shall be 18 years of age or older.  An individual under the age of 18 years of age may be the recipient of a hot lotto ticket, and may redeem the ticket.

 

          (b)  Once a ticket has been produced for the player, it shall be the sole responsibility of the player to verify the following are correct:

 

(1)  Desired draw date;

 

(2)  The player chosen 5, 2-digit numbers and one additional 2-digit number;

 

(3)  The dollar amount wagered;

 

(4)  The number of draws desired;

 

(5)  The ticket contains the New Hampshire hot lotto logo; and

 

(6)  The ticket contains the New Hampshire lottery logo.

 

          (c)  A hot lotto ticket shall not be canceled.

 

          (d)  A bet placed for a drawing which has already occurred shall be void.

 

          (e)  The price of a game play shall be determined by MUSL.

 

          (f)  Tickets shall be purchased only through authorized agents.

 

          (g)  A hot lotto ticket shall be a bearer instrument until such time as a signature is placed in the designated area on the back of the ticket.

 

          (h)  No prize shall be paid without the physical possession of a winning ticket.

 

          (i)  The lottery commission director shall make payment as directed by the person(s) whose signature(s) appear on the back of the ticket.

 

          (j)  In a case of a disputed prize, the lottery commission in concert with MUSL shall determine entitlement which may be appealed by the prize winner to a New Hampshire court of appropriate jurisdiction.

 

          (k)  The lottery commission shall not be responsible for lost or stolen tickets prior to their redemption.

 

          (l)  The lottery commission shall not replace lost or stolen tickets prior to their redemption.

 

          (m)  In the event a bet is not accepted and confirmed by the central computer system, the liability of the lottery commission and its agent shall be limited to a refund of the amount wagered, or if appealed, as determined by a New Hampshire court of appropriate jurisdiction.

          Sw 4001.03  Prize Pool.

 

          (a)  The prize pool for all prize categories shall consist of 50 per cent of each drawing period's sales, after the prize reserve accounts are funded to the amounts set by MUSL.

 

          (b)  Tickets containing the following number of matches in a single lettered game play, irrespective of drawing order, shall have the prize amount awarded as indicated for a one dollar bet as shown in Table 3.1.1 below:

          (c)  In circumstances where the prize payout exceeds available dollars in the prize pool, the set prize shall be paid on a pari-mutuel basis.

 

          (d)  If the grand prize is not won in a drawing, the prize money allocated for the grand prize shall roll over and be added to the grand prize pool for the following drawing.

          Sw 4001.04  Drawing.  Drawings shall be conducted on Wednesday and Saturday evenings, or as determined by MUSL.

          Sw 4001.05  Validation Requirements.

 

          (a)  A winning ticket shall be eligible to receive a prize if the following are true:

 

(1)  The winning ticket shall have been issued from an on-line terminal by an authorized lottery agent;

 

(2)  The winning ticket information shall have been recorded in the central computer system at least 59 minutes prior to the drawing;

 

(3)  All information appearing on the winning ticket shall correspond precisely with the lottery's computer record;

 

(4)  The 15 digit validation number and bar code shall appear in its entirety;

 

(5)  The winning ticket shall be intact, fully legible and correspond to the art work on file at the lottery;

 

(6)  The ticket shall not be defectively printed, fuzzy, unreadable, blank or partially blank, or defective; and

 

(7)  The ticket shall not be counterfeit in whole or in part, altered, reconstructed, tampered with in any manner, stolen or misregistered.

          Sw 4001.06  Ineligible Tickets.

 

          (a)  If a ticket does not meet the requirements of Sw 4001.05, the ticket shall be deemed void and ineligible for any prize.

          Sw 4001.07  Prize Payments.

 

          (a)  Claims for payment of a winning hot lotto ticket shall be made in accordance with the requirements set forth in Sw 600.

 

          (b)  Claims submitted to the lottery commission shall be subject to validation.

 

          (c)  The first annuitized jackpot share shall be paid not less than 15 calendar days following the claim.

          Sw 4001.08  Payment Election Review.  A player's share of the grand prize shall be paid, with either a per winner annuity or cash payment, subject to the following:

 

          (a)  The winner shall have no more than 60 days from the date a claim is filed to elect an annuity or a lump sum cash payment.

 

          (b)  If the payment election is not made within 60 days from the date of claim, the prize shall be paid as an annuity prize.

 

          (c)  The winner shall sign a statement furnished by the commission indicating their final election, either annuity or cash payment.

 

          (d)  The winner shall be under no obligation to accept the cash payment.

 

          (e)  The winner shall not be allowed to revoke, withdraw or otherwise change their final election.

          Sw 4001.09  Jackpot Assignments.  Payment of a prize may be made to a person other than the winner pursuant to the requirements of Sw 500.

          Sw 4001.10  Sizzler Promotion.

 

          (a)  The sizzler promotion shall be a limited extension of the hot lotto game and shall be conducted during a period of time designated by the commission in a public announcement.

 

          (b)  A qualifying play shall be any single hot lotto play for which the player shall pay an extra dollar for the sizzler option and which shall be recorded in the central computer system.

 

          (c)  A hot lotto sizzler ticket shall have the caption “Sizzler: Yes” on the ticket.

 

          (d)  A hot lotto sizzler that wins one of the 8 regular set prizes, as set forth in Table 3.1.1 shall be multiplied by 3. The jackpot shall not be a set prize and shall not be multiplied.

 

               (e)  The hot lotto game group may change the sizzler multiplier number for special promotions, for a specified period of time, to be announced by the commission in a public announcement.

 

          (f)  Except as provided in these rules, all hot lotto sizzler prizes awarded shall be paid as lump sum set prizes as set forth in Table 3.1.2, Expected Sizzler Prize Payout, below:

          (g)  Pursuant to Sw 4001.03 (c), if the set prize amounts are paid pari-mutuel the sizzler prizes shall be a multiple of the new hot lotto prize amount.

 

          (h)  Sizzler prizes valued at $100,000 or more shall be paid within 5 business days of the date of claim with the commission.
