STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Three
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Vaccine and Pharmaceutical Products. Amend RSA 125 by inserting after section 10 the following new section:
125:10-a Vaccine and Pharmaceutical Products. The state of New Hampshire and its political subdivisions, including but not limited to counties, cities, towns, precincts, water districts, school districts, school administrative units, or quasi-public entities, shall not purchase, promote, or distribute any vaccine or pharmaceutical product that has not been tested with voluntary, human, clinical trials.
2 Department of Health and Human Services; Duties; Reference Added. Amend RSA 125:9, VI to read as follows:
VI. Recognize the public health aspects relating to drugs and food under RSA 125:10 and RSA 125:10-a.
3 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill prevents the state or its political subdivisions from purchasing, promoting, or distributing any vaccine or pharmaceutical product that has not been tested with voluntary, human, clinical trials. The Department of Health and Human Services states that, with respect to COVID-19 vaccines specifically, all vaccines are currently purchased by the federal government and distributed to states, although the Department does expect COVID-19 vaccines to become available commercially at some point in 2023. The Department does not anticipate any immediate fiscal impact as a result of vaccines purchased or not purchased because of this bill.
