STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT establishing a committee to study regulations applicable to small businesses that sell food.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Committee Established.  There is established a committee to study regulations applicable to small businesses that sell food.

2  Membership and Compensation.

I.  The members of the committee shall be as follows:

(a)  Four members of the house of representatives, appointed by the speaker of the house of representatives, one of whom shall be a member of the commerce committee, one of whom shall be a member of the environment and agriculture committee, one of whom shall be a member of the resources, recreation and development committee, and one of whom shall be a member of the executive departments and administration committee.

(b)  One member of the senate, appointed by the president of the senate.

II.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3  Duties. The committee shall study:

I.  State and local regulations, including food licensing and food safety rules, applicable to small businesses that sell food.  

II.  The problems caused by the current food safety rules for small businesses.

III.  Whether food safety rules can be simplified and/or modified for small businesses that sell food.

IV.  Identify what future legislative actions, if any, are necessary to address the problems faced by small businesses that sell food in order to comply with current state and local requirements.

V.  Solicit information and testimony from the public, small business owners, and farmers, as well as representatives of the department of environmental services, the department of health and human services, and the department of agriculture, markets and food.

4  Chairperson; Quorum.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named house member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Three members of the committee shall constitute a quorum.

5  Report.  The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2022.

6  Effective Date.  This act shall take effect upon its passage.
