AMENDED ANALYSIS

This bill also prospectively repeals the prohibition when the final updated solid waste plan is published.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
AN ACT prohibiting the issuance of new landfill permits until the state's solid waste plan is updated.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Landfill Permits; Solid Waste Plan. Amend RSA 149-M:9 by inserting after paragraph V the following new paragraph:
V-a. The department shall not issue a permit for the construction of a new landfill, excluding the expansion of existing landfills, unless the department makes a positive determination that the permit application is consistent with the state's solid waste plan that has been updated consistent with the requirements of RSA 149-M:29.
2 Repeal. RSA 149-M:9, V-a, relative to issuance of permits for construction of new landfills, is repealed.
3 Contingency. Section 2 of this act shall become effective on the date the commissioner of the department of environmental services certifies to the director of the office of legislative services and the secretary of state that the publication of the solid waste plan update has been published in accordance with RSA 149-M:29.
I. Section 2 of this act shall take effect as provided in section 3 of this act.
II. The remainder of this act shall take effect upon its passage.

AN ACT prohibiting the issuance of new landfill permits until the state's solid waste plan is updated.

METHODOLOGY:
This bill prohibits the issuance of new landfill permits until the state's solid waste plan is updated. The Department of Environmental Services assumes the state solid waste plan will be updated by October 1, 2022. The Department states it currently only has one application that may be affected by this bill, however the application is incomplete and not expected to be ready for a permit decision until after the anticipated October 1, 2022 solid waste plan date, which would serve as the effective repeal of this bill's prohibition. Therefore, this bill will have no impact on state, county, and local revenue or expenditures.
