STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT establishing a commission to study extended producer responsibility.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Extended Producer Responsibility Study Commission.  Amend RSA 149-M by inserting after section 31 the following new section:

149-M:31-a  Extended Producer Responsibility Study Commission.  

I.  There is established a committee to study extended producer responsibility in order to provide relief to the cost of municipalities in solid waste disposal.

II.  The members of the commission shall be as follows:

(a)  Two members of the house of representatives, as appointed by the speaker of the house of representatives.

(b)  One member of the senate, as appointed by the president of the senate.

(c)  One member of the department of environmental services waste management council, appointed by that council.  

(d)  One member of the Northeast Resource Recovery Association, appointed by that association.

(e)  One member of the New Hampshire Municipal Association, appointed by that association.

(f)  One member of the Northeast Recycling Council, appointed by that council.

III.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

IV.  The commission's study shall include, but not be limited to:

(a)  Examining the waste reduction goals established in RSA 149-M with emphasis on the improvement of municipal recycling, reducing solid waste flow and reducing taxpayer costs in support of municipal transfer stations through extended producer responsibility.

(b)  Suggested legislation in order to help update RSA 149-M in order to better meet the waste reduction goals therein.

V.  The commission may solicit input from any person or entity the commission deems relevant to its study.

VI.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Four members of the commission shall constitute a quorum.

VII.  The commission shall submit a report including its findings and any recommendations for proposed legislation on or before September 1, 2022 to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library.

2  Repeal.  RSA 149-M:31-a, relative to the extended producer liability study commission, is repealed.

3  Effective Date.  

I.  Section 2 of this act shall take effect September 1, 2022.

II.  The remainder of this act shall take effect upon its passage.
