ANALYSIS

This bill requires the state to waive fees associated with the historic preservation of a property or structure designated as a New Hampshire heritage landmark, provided that it is restored with private funds and is not used for commercial purposes.

STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twelve

AN ACT relative to the waiver of state fees associated with historic preservation.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Historic Preservation; Waiver of State Fees. Amend RSA 227-C by inserting after section 26 the following new section:

227-C:26-a Historic Preservation; Waiver of State Fees. Notwithstanding any other provision of law, any state fees associated with the acquisition, relocation, restoration, and preservation of a property or structure designated as a New Hampshire heritage landmark by the state historic preservation office shall be waived, provided that the property or structure is restored and maintained with private funds and is not used for commercial purposes. Nothing in this section shall exempt the property or structure from applicable state and local property taxes or local zoning and land use regulations.

2 Effective Date. This act shall take effect 60 days after its passage.
