STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to requirements for literacy skill development in elementary grades.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Literacy Skill Development in Elementary Grades.  Amend RSA 189:53 to read as follows:

189:53 Literacy Skill Development in Elementary Grades.

I. All school districts [which] that provide elementary education shall [have] provide measurable, evidence-based instruction in literacy for all students through grade [3] 5, including: explicit, systematic instruction in [reading,] phonemic awareness, phonics (both decoding and encoding of sounds and words), fluency, vocabulary and comprehension; writing[,] (including grammar and mechanics); speaking[,]; listening[,]; mathematics reasoning[,]; and mathematics calculation (including fluency). All instruction shall be designed to assist students to achieve grade-level literacy and to provide the opportunity for each [child] student to learn according to such [child's] student's needs and abilities as set forth by the state board of education in the minimum standards for New Hampshire public elementary schools.

II.  General education tier 2 intervention referrals shall be made for any student who does not meet expected grade-level competencies in any or all of the areas of instruction on or before demonstrating skills 6-months below that of their same-grade peers.  Students who do not make meaningful gains to lessen the achievement gap in one or more identified instructional areas shall be referred to special education on or before demonstrating skills one-year below grade-level expectations, or sooner if an educational disability is suspected.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill, presumed effective in FY 2025, requires schools to provide measurable, evidence-based instruction in literacy for all students from kindergarten through grade 5.  The Department of Education states it is unable to estimate this bill’s impact on local expenditures, by individual school district or statewide total, as it does not have information on current practices in place regarding evidence-based materials in phonemic awareness, phonics (both decoding and encoding of sounds and words), fluency, vocabulary, and comprehension; writing (including grammar and mechanics); speaking, listening; mathematics reasoning, and mathematics calculation (including fluency). In addition, the Department states costs for special education referral and diagnostics would be incurred by the local education agency. Ultimately, this bill may increase local expenditures by an indeterminable amount in FY 2025 and each year thereafter.
