STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to requiring certain employers to use the federal E-Verify system of the United States Citizenship and Immigration Services.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Employment of Undocumented Workers Prohibited; E-Verify.  Amend RSA 275-A:4-a to read as follows:

275-A:4-a  Employment of Undocumented Workers Prohibited.  No employer may employ any employee without obtaining documentation showing the employee's eligibility to work in the United States.  If the employer has 25 or more employees, the employer shall verify employment eligibility through the E-Verify system of the United States Citizenship and Immigration Services.  The employer shall maintain such documentation for the period required by federal law.  Acceptable documentation of eligibility to work in the United States shall include documents required by federal law or supporting documentation that satisfies the requirement of federal law.

2  Effective Date.  This act shall take effect January 1, 2025.
