STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to medication administration by direct care staff in residential care facilities.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Nurse Practice Act; Exemptions; Administration of Medication by Direct Care Staff in Residential Care Facilities.  Amend RSA 326-B:43, VI to read as follows:

VI.  The administration of medications, by any person employed or under contract, to provide direct care to clients receiving community-based services pursuant to RSA 135-C or RSA 171-A or to residents of a residential care facility licensed under RSA 151:2, I(e), provided that persons delivering such care who administer medications shall have successfully completed a medication administration educational program conducted by an RN and approved by the board under rules adopted pursuant to RSA 541-A.  The commissioner of health and human services, in consultation with the board, shall adopt rules under RSA 541-A establishing criteria for the administration of medications, and for the process of approving an RN to conduct the medication administration educational program.

2  Effective Date.  This act shall take effect 60 days after its passage.
