STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to the use of OHRVs on designated trails and requiring a permit to operate certain OHRVs from before sunrise to after sunset.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Off Highway Recreational Vehicles; Operation of All OHRVs.  Amend RSA 215-A:6 by inserting after paragraph XI the following new paragraph:

XII.  No OHRV registered in this state or any other jurisdiction for use on a way in this state, except OHRVs registered for purposes under RSA 261:41-a, shall be used recreationally on designated OHRV trails.

2  New Paragraph; Off Highway Recreational Vehicles; Registration.  Amend RSA 215-A:21 by inserting after paragraph X the following new paragraph:

XI.  No OHRV registered in this state or any other jurisdiction for use on a way in this state, except OHRVs registered for purposes under RSA 261:41-a, shall be used recreationally on designated OHRV trails.

3  Off Highway Recreational Vehicles; Events.  Amend the introductory paragraph in RSA 215-A:30, I to read as follows:

I.  Any person, organization or corporation who wishes to operate or to promote any snow traveling vehicle or OHRV or snowmobile event or contest involving the use of unregistered snowmobiles or unregistered OHRVs, operation of OHRVs on public ways, operation of OHRVs with an exhaust louder than 96 decibels, or operation of an OHRV during the period 1/2 hour after sunset to 1/2 hour before sunrise shall procure a permit from the executive director.  The application for the permit shall be on an annual basis, shall include a listing of scheduled events and shall be accompanied by an annual fee of $50.  Participants in an event or contest shall not be required to register in New Hampshire, but shall operate under the provisions of the permit.  Any such participant who is not registered in New Hampshire shall not operate away from the race course or contest area specified in the permit.  Distribution of any fees collected under this section shall be as follows:

4  Effective Date.  This act shall take effect 60 days after its passage.
