NOTE:

 

        Established by 1991, 334:3, effective 6-28-91, the Community Development Finance Authority was explicitly granted rulemaking authority under RSA 162-L:16, IV pursuant to 2003, 319:13, effective 7-1-03.  Existing rules Pln 300 relative to the Community Development Block Grant Program were transferred from the Office of State Planning to the Authority pursuant to 2003, 319:14, II, effective 7-1-03.

        The Community Development Finance Authority became exempt from RSA 541-A pursuant to 2019, 299:2 and 299:3, effective 7-29-19, which inserted RSA 541-A:21, I(kk) and adopted RSA 162-L:4-a, respectively.  Pursuant to RSA 162-L:4-a, the Authority “may adopt rules in accordance with its own procedures to facilitate, implement, and carry out the powers, duties, and purposes of the authority enumerated in this chapter and additional powers and purposes as shall be conferred upon it.”  Cdfa 300, which expired 5-14-19, remains out of effect unless or until adopted again by the Authority under its own procedures, and the Authority does not have to file with the Administrative Rules office of the Office of Legislative Services.  Questions for the latest version should therefore be directed to the Authority.
