PART Crv 101  PURPOSE

 

          Crv 101.01  Purpose.  The purpose of these rules is the implementation of RSA 227-E.

PART Crv 102  DEFINITIONS

 

          Crv 102.01  “Commission” means the Connecticut River Valley Resource Commission established by RSA 227-E:3.

PART Crv 103  DESCRIPTION OF THE COMMISSION

 

          Crv 103.01  Composition of the Commission.  The commission is comprised of 15 New Hampshire residents as follows:

 

          (a)  A member of the North Country Council designated by the council;

 

          (b)  A member of the Upper Valley-Lake Sunapee Council, designated by the council;

 

          (c)  A member of the Southwest Regional Planning Commission designated by that commission;

 

          (d)  A member of the Connecticut River Watershed Council designated by the council;

 

          (e)  A New Hampshire member of the Connecticut River Flood Control Commission designated by that commission;

 

          (f)  A representative of a hydro-electric concern located within the Connecticut River valley;

 

          (g)  A representative of a recognized statewide conservation organization;

 

          (h)  A representative of the commercial tourism industry;

 

          (i)  A representative of the agricultural industry who is actively engaged in farming;

 

          (j)  A representative of the forest product industry or a timberland owner; and

 

          (k)  Five additional members appointed by the governor and council from a list of nominees submitted by the commission members appointed under RSA 227-E:4, I(a) through (j).

          Crv 103.02  Responsibilities of the Commission.  The commission’s responsibilities include:

 

          (a)  Assembling and publishing a comprehensive inventory of natural resources of the Connecticut River valley;

 

(b)  Coordinating a regional promotional program with the department of resources and economic development;

 

(c)  Providing for interstate cooperation with the state of Vermont;

 

(d)  Cooperating with local communities and regional planning commissions;

 

(e)  Reviewing and evaluating other river and watershed protection endeavors;

 

(f)  Seeking and expending additional public and private funds;

 

(g)  Encouraging the protection of agricultural, historical, and natural resources, and the provision of additional public access to recreational sites; and

 

(h)  Providing grants to further the purposes of the commission.

Crv 103.03  The Commission as the Local River Management Advisory Committee for the Connecticut River.

 

(a)  Pursuant to RSA 483:8-a, IV the commission has been appointed by the commissioner of environnmental services to be the local river management advisory committee for the Connecticut River.

 

(b)  As the local river management advisory committee it works with the Vermont Connecticut River watershed advisory commission established by the Vermont legislature in 1988.

 

(c)  To carry out its work as the local river management advisory committee and pursuant to RSA 483:8-a, IV, the commission has established the following 5 subcommittees:

 

(1)  Headwaters local river subcommittee;

 

(2)  Riverbend local river subcommittee;

 

(3)  Upper valley local river subcommittee;

 

(4)  Mt. Ascutney local river subcommittee; and

 

(5)  Wantastiquet local river subcommittee.

 

          (d)  Each of the subcommittees meets at least 4 times each year.

Crv 103.04  Meetings of the Commission.

 

          (a)  The commission holds regular meetings each month.

 

          (b)  The commission chair calls special commission meetings as needed or at the written request of three members.

          Crv 103.05  Attendance at Meetings By Members of the Public.  Pursuant to RSA 91-A:2, II, members of the public may attend and record commission meetings, except for those parts of the meetings which are nonpublic sessions as defined in RSA 91-A:3.

          Crv 103.06 Notice of Meetings.

 

          (a)  Notice of the time and place of commission meetings, excluding emergency meetings, shall be given to the public by the commission in accordance with RSA 91-A:2, II.

 

          (b)  Information about the time and place of commission meetings shall also be available by telephone at the number stated in Crv 104.01(b) and by TTY/TDD by using the number stated in Crv 104.01(c).

Crv 103.07  Minutes of Commission Meetings.

 

(a)  Minutes shall be kept of commission meetings and of official actions taken.

 

(b)  Such minutes shall:

 

(1)  Record the commission members participating in each vote; and

 

(2)  Separately record the position of commission members who dissent, abstain or concur.

Crv 104.02  Communication with the Commission.

 

(a)  Persons wishing to make submissions to, or requests of, the commission may mail a letter to the address stated in Crv 104.01(a), call the number stated in Crv 104.01(b) or communicate by TTY/TDD using the number stated in Crv 104.01(c).

 

(b)  Persons seeking information from the commission may do so by mail, telephone or TTY as described in paragraph (a).

Crv 104.03  Public Access to Records.

 

(a)  Pursuant to RSA 91-A:4 members of the public may inspect and copy those records of the commission, including meeting minutes, which are public records and not exempt from disclosure under RSA 91-A:5 or other applicable law.

 

(b)  Public records shall be inspected and copied at the office of the commission at the location stated in Crv 104.01(a) during regular business hours.

 

(c)  Persons desiring copies of public records shall reasonably describe the information being sought and pay the actual cost of the copies.

 

(d)  If records are requested which contain both public information and information exempt from disclosure, the commission shall delete the exempt information and provide the remaining information.
