          Saf-C 1701.03  "Axle" means an assembly of a vehicle consisting of 2 or more wheels whose centers are in one horizontal plane by means of which a portion of the weight of a vehicle and its load, if any, is continually transmitted to the roadway.  For purposes of registration, an axle includes any such assembly whether or not it is load-bearing only part of the time such as a single unit truck with a steering axle and 2 axles in a rear-axle assembly, even though one of the rear axles is a so-called "dummy", "drag", "tag" or "pusher" type axle.

PART Saf-C 1702  FEES

 

          Saf-C 1702.01  Determination of Fees.

 

          (a)  The registration fee for an apportionable vehicle shall be determined as follows:

 

(1)  In-jurisdiction miles shall be divided by the total miles generated during the preceding year;

 

(2)  The total fees required under the laws of each jurisdiction for full registration of each vehicle at the regular annual or applicable fees, or for the unexpired portion of the registration year shall be calculated; and

 

(3)  The sum obtained in (2) above shall be multiplied by the quotient obtained in (1) above.

          Saf-C 1703.02  Original Application.

 

          (a)  Each applicant shall complete an original application on schedule A/E and schedule B.

 

          (b)  Each applicant shall supply on or with schedule A/E the following:

 

(1)  Name of the person, firm or corporation requesting a New Hampshire apportioned registration;

 

(2)  Business address;

 

(3)  Mailing address, to where all correspondence will be sent;

 

(4)  Name, address and telephone number of person to be contacted to answer questions pertaining to the application;

 

(5)  Whether the operation is an exempt commodity carrier, household goods carrier, private carrier, for hire carrier, rental company or whether the fleet is leased to a private carrier or for hire carrier;

 

(6)  Maximum weights to be carried in each jurisdiction in which the fleet will be apportioned;

 

(7)  The following information for each vehicle to be registered:

 

a.  Equipment number;

 

b.  Manufacturer's model, year and make;

 

c.  Complete vehicle identification number (VIN);

 

d.  Vehicle type, using the abbreviations listed at the top of schedule A/E;

 

e.  Number of axles for each truck or tractor combination, or number of seats for each bus;

 

f.  Unladen weight;

 

g.  Fuel type, using the abbreviations listed at the top of schedule A/E;

 

h.  Combined or gross weight, meaning the unladen weight of the vehicle plus the weight of the load;

 

i.  Actual purchase price;

 

j.  Manufacturer's list price of the full equipped vehicle when new;

 

k.  Date of purchase, if purchased;

 

l.  Date of lease, if leased;

 

m.  Name and signature of owner, if other than the applicant;

 

n.  Number of current title certificate;

 

o.  Horsepower, if the vehicle is a bus;

 

p.  Abbreviation of title state, using 2 digits;

 

q.  Current license plate number and state of registration;

 

r.  United States Department of Transportation (US DOT) number; and

 

s.  Taxpayer identification number;

 

(8)  Total of:

 

a.  Power units in the fleet;

 

b.  Trailers in the fleet; and

 

c.  Vehicles in the fleet;

 

(9)  Operating authority issued by the Federal Motor Carrier Safety Administration (FMCSA), to the jurisdictions requested, if applicable; and

 

(10)  Signature of person authorized to apply for the apportioned registration and date signed.

 

          (c)  For the purposes of (b)(2) above and (g)(2) below, a post office box shall not be acceptable.

 

          (d)  For the purposes of (b)(6) above, separate pages shall be used if the weights in all jurisdictions are different for each vehicle.

 

          (e)  For the purposes of (b)(8) above, an applicant shall assign a unique number or letter to each vehicle in the fleet.

 

          (f)  For the purposes of (b)(7)p. above, if a vehicle has not been previously registered in New Hampshire, the applicant shall submit a copy of the title certificate from the state of current registration. If a vehicle is titled in a state other than the state of registration or if a vehicle is not yet titled, the applicant shall submit an application for a New Hampshire title certificate.

 

          (g)  Each applicant shall supply on or with schedule B the following:

 

(1)  Name of person, firm or corporation requesting a New Hampshire apportioned registration;

 

(2)  Business address;

 

(3)  Mailing address, to where all correspondence will be sent;

 

(4)  The reporting period;

 

(5)  Name, address and telephone number of person to be contacted to answer questions pertaining to the application;

 

(6)  Whether the operation is an exempt commodity carrier, household goods carrier, private carrier, for hire carrier, rental company or whether the fleet is leased to a private carrier or for hire carrier;

 

(7)  Mileage in each jurisdiction in which the fleet traveled during the year preceding the current registration year being applied for;

 

(8)  An "X" shall be placed beside each IRP member jurisdiction in which the applicant wishes to have an apportioned registration;

 

(9)  An explanation of any mileage estimated; and

 

(10)  Signature of person authorized to apply for the apportioned registration and date signed.

 

          (h)  For the purposes of (g)(7) above, the following shall apply:

 

(1)  If no reportable mileage for the previous year is available for a jurisdiction that will be traveled through, an estimate of miles to be traveled shall be entered;

 

(2)  Mileage shall be entered whether the jurisdiction is an IRP member or not; and

 

(3)  Mileage shall be entered separately for each jurisdiction.

 

          (i)  Each applicant shall have an established place of business which is registered with the secretary of state’s office in New Hampshire.

 

          (j)  Each applicant shall ensure that records are maintained and available for audit.

          Saf-C 1703.09  Federal Heavy Truck Use Tax.

 

          (a)  Whenever an application is received for an apportioned registration of a vehicle with a taxable gross weight of 55,000 pounds or greater, the registrant shall submit proof of payment of the federal heavy truck use tax or proof of suspension of the tax to the department.

 

          (b)  Proof of payment shall consist of form 2290, receipted schedule 1, validated by the  Internal Revenue Service.

 

          (c)  If a fleet has more than 21 vehicles, the applicant shall attach additional sheets as necessary and shall include a list of the vehicles to be registered, vehicle identification number of each vehicle and a certification that the federal heavy truck use tax has been paid for each vehicle.

 

          (d)  A gross weight shall be declared for each vehicle.  The gross weight shall be shown on the tax receipt and schedule A/E or the computer registration print-out.  The weights on these forms shall be the same as those weights reported to the Internal Revenue Service on schedule 1.

 

          (e)  The federal heavy truck use tax shall be paid directly to the Internal Revenue Service.  It shall not be accepted by the department.

 

          (f)  In the event that an applicant has not received a validated schedule 1, form 2290, from the Internal Revenue Service, the following shall be accepted as proof of payment:

 

(1)  A photocopy of form 2290;

 

(2)  A photocopy of schedule 1; and

 

(3)  A photocopy of both sides of a canceled check of a check validated by the  Internal Revenue Service.

(14)  An estimate of the total fleet miles to be traveled in the added jurisdiction;

 

(15)  A brief statement explaining why the jurisdiction is to be added to the fleet territory, including a revised mileage estimate based upon travel in the added jurisdiction;

 

(16)  Operating authority issued by the FMCSA, if required by the jurisdiction to be added; 

 

(17) US DOT number;

 

(18)  Taxpayer identification number; and

 

(19)  Signature of person authorized to add a jurisdiction to the fleet, and date signed.

 

          (b)  For the purposes of (a)(6) above, a post office box shall not be acceptable.

PART Saf-C 1705  REGISTRATION OF RENTAL VEHICLES

 

          Saf-C 1705.01  Privileges.

 

          (a)  Rental fleets owned by any person engaged in the business of renting such vehicles shall be extended full interstate or intrastate privileges, provided that:

 

(1)  The vehicles are part of a rental fleet and identified as being part of that fleet;

 

(2)  The person has received approval from the jurisdiction to apportion such rental fleet;

 

(3)  The person registers the vehicle as follows:

 

a.  For trucks and tractors, in accordance with the fees for apportionable vehicles set forth in these rules;

 

b.  For rental cars, in accordance with RSA 260:75, XI, A 3.(b).; and

 

c.  For one way vehicles, which are those vehicles that are rented in one location and left in another location, as follows:

 

1.  Trucks of less than 26,000 pounds gross vehicle weight operated as part of an identifiable one-way fleet shall allocate vehicles to the respective jurisdictions based upon the mileage factor procedure set forth in Saf-C 1702 and fully register the allocated vehicles in such jurisdiction; and

 

2.  All trucks of one-way fleets so qualified shall be allowed to perform both interstate and intrastate movements in all jurisdictions.

          Saf-C 1706.01  Supplemental Application.

 

          (a)  A registrant who wishes to add or delete vehicles to a fleet or change weight, after filing an original application, shall submit a supplemental application, schedule C/E.

 

          (b)  In addition to all of the information required on schedule A/E, pursuant to Saf-C 1703.02, each registrant shall supply on or with schedule C/E the following:

 

(1)  The IRP account number assigned when the original application was filed;

 

(2)  The fleet number, if different fleets are registered under the same company name;

 

(3)  Information for each vehicle being added, which shall include the following:

 

a.  Equipment number uniquely assigned to each vehicle in the fleet;

 

b.  Manufacturer's year, model and make;

 

c.  Complete vehicle identification number (VIN);

 

d.  Vehicle type, using the abbreviations listed at the top of schedule C/E;

 

e.  Number of axles for each truck or tractor combination, or number of seats for each bus;

 

f.  Unladen weight;

 

g.  Fuel type, using the abbreviations listed at the top of schedule C/E;

 

h.  Combined or gross weight, meaning the unladen weight of the vehicle plus the weight of the load;

 

i.  Actual purchase price;

 

j.  Manufacturer's list price of the fully equipped vehicle when new;

 

k.  Date of purchase, if purchased;

 

l.  Date of lease, if leased;

 

m.  Name and signature of owner, if other than the registrant;

 

n.  Number of current title certificate;

 

o.  Horsepower, if the vehicle is a bus;

 

p.  Abbreviation of title state, using 2 digits;

 

q.  Current license plate number and state of registration;

 

r.  US DOT number; and

 

s.  Taxpayer identification number;

 

(4)  Information for each vehicle being deleted, which shall include the following:

 

a.  Equipment number uniquely assigned to each vehicle in the fleet;

 

b.  Manufacturer's year, model and make;

 

c.  Complete vehicle identification number (VIN);

 

d.  Combined or gross weight, meaning the unladen weight of the vehicle plus the weight of the load; and

 

e.  Reason for deletion, such as:

 

1.  Sale of vehicle;

 

2.  Wrecked vehicle;

 

3.  Junked vehicle; or

 

4.  Fleet transfer; and

 

(5)  Signature of person authorized to add or delete vehicle(s) and date signed.

 

          (c)  For the purposes of (b)(3)p. above, if a vehicle has not been previously registered in New Hampshire, the applicant shall submit a copy of the title certificate from the state of current registration. If a vehicle is titled in a state other than the state of registration or if a vehicle is not yet titled, the applicant shall submit an application for a New Hampshire title certificate.

          (c)  In order to obtain credits, the cab card for a deleted vehicle shall be returned with the supplemental application.

 

          (d)  Each addition of a newly acquired vehicle shall include a completed application for a certificate of title.

          Saf-C 1706.05  Full Refund for Deleted Vehicles.

 

          (a)  A full refund for a deleted vehicle shall be granted only when cab card(s) are returned unattached within 30 days of issuance and no temporary registration was issued.

 

          (b)  A refund of remaining registration fees for a deleted vehicle shall be granted only if the vehicle has been destroyed and replaced by an additional vehicle for which an apportioned registration can be transferred.

 

          (c)  No refund shall be given if a vehicle has been stolen, sold, retired, or a lease has been broken, and the vehicle has not been replaced.

 

          (d)  A refund shall be given if the vehicle is replaced by an addition to a fleet on the same supplemental application.  Any balance over $1.00 shall be refunded to the carrier.  Any additional fees, over $1.00, shall be billed to the carrier.

 

          (e)  Pursuant to RSA 261:141, there shall be a $10 transfer fee for each add-delete transaction.

 

          (f)  A refund shall not be allowed for any vehicle which is not permanently removed from the fleet.  A vehicle which has been removed for repair or rebuilding shall not be considered permanently removed.

          (c)  The trip permit shall allow for interstate and intrastate operation.

(1)  Beginning and ending dates for which the permit is requested;

 

(2)  License holder's name;

 

(3)  Current plate number;

 

(4)  Mailing address;

 

(5)  Vehicle make, year, fuel type, registered weight and vehicle identification number;

 

(6)  State of registration;

PART Saf-C 1711  TEMPORARY AUTHORIZATION

 

          Saf-C 1711.01  Temporary Registration Authorization.

 

          (a)  A New Hampshire based carrier who wishes to add a vehicle to an existing fleet shall obtain a temporary registration authorization.

 

          (b)  The fee for a temporary registration authorization shall be $10, pursuant to RSA 260:52, VI.

 

          (c)  A temporary registration authorization shall only constitute temporary registration of the vehicle and shall obligate the carrier to complete the process for permanent registration in accordance with these rules.

 

          (d)  A supplemental application, schedule C/E, shall be filed within 10 days of issuance of a temporary registration authorization or the registrant's privilege to operate in New Hampshire shall be suspended.

 

          (e)  A temporary registration authorization shall also be issued when an apportioned registration has been obtained until the permanent registration plates are received.

          (a)  Each registrant requesting a temporary registration authorization shall complete an application.

 

          (b)  Each registrant shall supply on or with the application for temporary registration authorization the following:

 

(1)  Applicant's name;

 

(2)  IRP account number and equipment number;

 

(3)  Owner's name;

 

(4)  Mailing address;

 

(5)  Vehicle identification number;

 

(6)  Vehicle type, year, make and gross weight;

 

(7)  Number of axles for each truck or tractor combination, or number of seats for each bus;

 

(8)  Fuel type;

 

(9)  Current plate number;

 

(10) US DOT number;

 

(11)  Jurisdictions and weights to be registered;

 

(12)  Certification that the information is true and that the temporary registration authorization will be used in accordance with applicable statutes and rules;

 

(13)  Signature of applicant and date signed;

 

(14)  Beginning and ending dates for which the temporary registration authorization is requested;

 

(15)  A statement that the temporary registration authorization shall be valid for 45 days from the date of issuance, pending permanent registration; and

 

(16)  Acknowledgement that an application for a permanent apportioned registration shall be filed within 10 days of issuance of the temporary registration authorization or the registrant's privilege to operate in New Hampshire shall be suspended.

 

          (c)  A temporary registration authorization shall also be available from permit service companies.

 

          (d)  A temporary registration authorization shall allow a New Hampshire based fleet vehicle to operate in the listed jurisdictions and at the listed weights for a period of 45 days pending issuance of permanent IRP registration.

PART Saf-C 1712  AUDITS AND RECORD REQUIREMENTS

 

          Saf-C 1712.01  Audits.

 

          (a)  Each apportioned carrier shall preserve the operational records on which the registration application is based plus the operational records for the 3 prior mileage reporting periods.

 

          (b)  Notice of intent to audit shall be given to the carrier.

 

          (c)  Authenticity of mileage and registration shall be verified and an assessment made for any deficiencies found due.

 

          (d)  Any apportioned carrier who refuses to comply with the mileage reporting requirement shall not be entitled to an apportioned registration.

          Saf-C 1712.02  Records.

 

          (a)  Each carrier shall keep operational records.  These may include computer printouts that can be supported by source documents when requested.

 

          (b)  An acceptable source document to verify fleet mileage shall be some type of individual vehicle distance record (IVDR).

 

          (c)  Each IVDR shall include the following:

 

(1)  Beginning and ending dates;

 

(2)  Trip origin and destination;

 

(3)  Route of travel;

 

(4)  Beginning and ending odometer reading of the trip;

 

(5)  Total trip miles, including all movement, loaded, empty, or bobtail miles;

 

(6)  Mileage by jurisdiction;

 

(7)  Equipment number or vehicle identification number;

 

(8)  Fleet number;

 

(9)  Registrant's name;

 

(10)  Trailer number; and

 

(11)  Signature, name of driver, or both.

 

          (d)  An IVDR shall be completed for each movement of a vehicle.  Each registrant shall be able to explain any unaccounted time lapse of vehicle movement.

 

          (e)  Computer printouts and monthly reports such as fuel reports which are merely recaps, shall not be acceptable at face value.  They shall be supported by an IVDR in order to be used during an audit.  Trip leases during the mileage reporting period shall be attached to the IVDR.  Miles operated pursuant to a trip permit shall be included.

 

          (f)  Each registrant shall accumulate IVDR's and prepare a monthly recap in which the miles are broken down by unit and by state.  This monthly recap shall be used to prepare a yearly recap.

 

          (g)  Each registrant shall maintain mileage records as follows:

 

(1)  Mileage records supporting the current registration year; and

 

(2)  Mileage records supporting the 3 previous registration years.

 

          (h)  Each registrant failing to maintain adequate records for a unit or units qualified in the registrant's fleet during the reporting period shall provide evidence of non-use or the registrant shall be subject to the full assessment of fees for each unit involved.

 

          (i)  A full fee assessment shall be charged for, but not limited to, the following:

 

(1)  Odometer readings that are different than the total number of miles reported; and

 

(2)  Reported mileage for deliveries which are less than the actual mileage.

PART Saf-C 1713  PROCEDURE FOR PROTESTED CHECKS

 

          Saf-C 1713.01  Protested Checks.

 

          (a)  When a person submits a check under the provisions of the IRP and the check is returned as uncollectible, the person shall be assessed a penalty pursuant to RSA 6:11-a.

 

          (b)  Upon return of the check, the department shall follow the procedures set forth in Saf-C 211.03, for the purpose of obtaining full payment of all monies owed to the department.

 

          (c)  In the event a person fails, neglects or refuses to pay the full amount due to the department, that person's vehicle registration shall be suspended and all jurisdictions in the IRP shall be notified.

 

          (d)  In the event more than one check is returned as uncollectible within a 24 month period:

 

(1)  The director shall order the registrant to pay all IRP fees by certified funds; and

 

(2)  The registrant's record shall be reviewed annually and if no further violations of these rules have occurred, the director shall rescind the order in (1) above.
