STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to the state's duty to protect children in public schools.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Education; State Board of Education.  Amend RSA 186 by inserting after section 5 the following new section:

186:5-a  Duty to Protect.  Children in the public schools are there because of state requirements,

where the children do not have their parents with them.  The state is acting as the temporary guardian in loco parentis during those times and therefore the state has an obligation to use reasonable care to protect the child during those hours.

2  Effective Date.  This act shall take effect 60 days after its passage.
