This bill prohibits the state and its political subdivisions from purchasing, promoting, or distributing any vaccine or pharmaceutical product that has not been tested with voluntary, human, clinical trials.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to vaccine and pharmaceutical products purchased, promoted, or distributed by the state and its political subdivisions.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Vaccine and Pharmaceutical Products.  Amend RSA 125 by inserting after section 10 the following new section:

125:10-a  Vaccine and Pharmaceutical Products.  The state of New Hampshire and its political subdivisions, including but not limited to counties, cities, towns, precincts, water districts, school districts, school administrative units, or quasi-public entities, shall not purchase, promote, or distribute any vaccine or pharmaceutical product that has not been tested with voluntary, human, clinical trials.  This section shall not apply to the annual flu vaccine or when a state of emergency has been declared by the governor. In a state of emergency, the state shall not compel forced vaccinations of any New Hampshire citizen.

2  Department of Health and Human Services; Duties; Reference Added.  Amend RSA 125:9, VI to read as follows:

VI. Recognize the public health aspects relating to drugs and food under RSA 125:10 and RSA 125:10-a.

3  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill prevents the state or its political subdivisions from purchasing, promoting, or distributing any vaccine or pharmaceutical product that has not been tested with voluntary, human, clinical trials.  The bill does not apply to the annual flu vaccine or any situation in which a state of emergency has been declared by the governor.  The Department of Health and Human Services utilizes a mix of federal funds and NH Vaccine Association funds to purchase vaccines on behalf of healthcare providers participating in the Vaccines For Children (VFC) program.  The Department states that it has budgeted $4,884,047 for the purchase of COVID-19 vaccines, primarily for children, as part of this program for FY24.  The Department further notes that, on average, vaccine prices increase by approximately 4 percent per year.  Therefore, the Department predicts that in future years the COVID-19 vaccine would cost the state the following, which presumably would not be spent should the bill become law: FY25, $5.1 million; FY26, $5.3 million; FY27, $5.5 million.

 

The Department states it is unclear whether the bill is intended to apply to vaccines other than those for COVID-19; if so, the decrease in expenditures may be greater than those shown above. The Department anticipates that if the bill is enacted, there may be an indeterminable increase in Medicaid and other health care costs related to an increased number of COVID cases.
