STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to the establishment of the injury prevention number plates trust fund.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Chapter; Injury Prevention Number Plates.  Amend RSA by inserting after chapter 261-C the following new chapter:

CHAPTER 261-D

INJURY PREVENTION NUMBER PLATES

261-D:1  Injury Prevention Number Plates.

I.  The director is hereby authorized to issue special injury prevention number plates, in lieu of other number plates.  The design of these special plates shall be determined by the commissioner of safety.  The plates shall retain the "live free or die" logo.  Such plates shall be issued only upon application and upon payment of a $25 fee that shall be in addition to the regular motor vehicle registration fee and any other number plate fees otherwise required.

II.  The commissioner is also authorized to issue vanity injury prevention number plates.  The fee for any such vanity injury prevention number plate shall be the fee as provided in this section, in addition to the fees for vanity plates which are otherwise established by law.  The vanity plate portion of the fee shall be distributed as provided in RSA 261-D:2 and RSA 263:52.

III.  The department shall retain such sum as is necessary to recover production and administrative costs as approved by the fiscal committee of the general court.  The remaining funds shall be paid to the state treasurer and distributed as provided in RSA 261-D:2.  Plates shall be renewed on an annual basis for $25 per set.  Of this sum, $5 shall be retained by the department and $20 shall be paid to the state treasurer and distributed as provided in RSA 261-D:2.  The cost of replacement number plates shall be identical to the cost of initial number plates and the revenue from replacement number plates shall be distributed in the same manner as revenue derived from initial number plates.

261-D:2  Injury Prevention Number Plate Trust Fund.

I.  There is hereby established an injury prevention number plate trust fund under the administration of the state treasurer.  The fund shall be used for the promotion, protection, and investment in the state’s injury prevention center partners' injury prevention programs.  The fund shall be nonlapsing.  The state treasurer shall distribute the funds annually on July 1 equally among the department of health and human services, department of safety, and state designated injury prevention center.

II.  Each department and state's injury prevention center injury prevention partner receiving funding from the injury prevention number plate trust fund shall establish a line item in their budget.  Moneys received from the injury prevention number plate trust fund shall be in addition to any other sums appropriated and shall not replace base funding received by any of these departments or state's injury prevention center through the budget process.

2  New Subparagraph; Application of Receipts; Injury Prevention Number Plate Trust Fund.  Amend RSA 6:12, I(b) by inserting after subparagraph (394) the following new subparagraph:

(395)  Moneys deposited in the injury prevention number plate trust fund established in RSA 261-D:2.

3  Effective Date.  This act shall take effect July 1, 2024.

METHODOLOGY:

This bill authorizes the Division of Motor Vehicles to issue injury prevention number plates and establishes the injury prevention number plate trust fund. This plate would cost $25 and would be distributed as follows (ultimately, this bill’s impact on revenue is indeterminable as it is not known how many individuals may choose this new plate type):

 

  • $5 per registration to be retained by the Department of Safety. This bill states the Department “shall retain such sum as is necessary to recover production and administrative costs as approved by the fiscal committee of the general court”. It is unclear whether this amount is capped at the $5 per plate or if the Department would recover all its costs. The Department states it would incur a one-time cost of $24,000 in FY 2025 for system programing costs to implement this bill. Assuming allocations to the Department of Safety are capped at $5 per plate, it would take 4,800 registrations to fully recover initial costs.

 

  • $20 per registration to be allocated to a newly established dedicated fund called the “Injury Prevention Number Plate Trust Fund”. Proceeds in this fund would be allocated annually to the Department of Health and Human Services, Department of Safety, and “state designated injury prevention center”. It is assumed that the amount allocated to each entity would be determined in the state budget process.
