This bill requires school sports teams to be expressly designated as male, female, or coed, and prohibits biologically male students from participating in female designated sports or entering female locker rooms.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to biological sex in student athletics.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Biological Sex in Student Athletics.  Amend RSA 193-F by inserting after section 10 the following new section:

193-F:11  Biological Sex in Student Athletics.  

I.  As used in this section:

(a)  "School" means a public school or a not-for-profit nonpublic school whose athletic teams compete against a public school.

(b)  "Sex" means the biological state of being female or male, based on an individual's nonambiguous sex organs, chromosomes, and endogenous hormone profile at birth.

(c)  "Student" means an individual enrolled at a school.

II.  An interscholastic or intramural athletic team or sport sponsored by a school must be expressly designated as one of the following based on the sex of the intended participants:

(a)  "Males", "men", or "boys";

(b)  "Females", "women", or "girls"; or

(c)  "Coed" or "mixed".

III.  An athletic team or sport designated for "females", "women", or "girls" may not be open to students of the male sex.

IV.  A locker room or restroom that is designated for "females", "women", or "girls" may not be open to students of the male sex.

V.  This section shall not be construed to restrict the eligibility of a student to participate in interscholastic or intramural athletic teams or sports designated as "males", "men", or "boys" or designated as "coed" or "mixed".

2  Effective Date.  This act shall take effect 60 days after its passage.
